: Waiver service providers, lead agency staff and other interested stakeholders
: DHS Disability Services and Aging and Adult Services divisions
To remind providers that the deadline to complete an online provider attestation was Sept. 1, 2017

Provider attestation deadlines

All enrolled Minnesota home and community-based services (HCBS) waiver providers should have completed an online provider attestation by Sept. 1, 2017. The attestation demonstrates that they meet new settings regulations under the HCBS rule. If they could not complete the attestation on time, providers were able to request a hardship extension.

Providers that are non-responsive (no attestation submitted)

A small number of providers have not submitted an attestation. Minnesota Health Care Programs (MHCP) will not allow non-responsive providers to submit any claims for MHCP payment for services delivered on or after Oct. 8, 2017.

After DHS receives an attestation form or a request for a hardship extension from non-responsive providers, they may resume submitting claims. These providers have received letters via direct mail and their provider MN.ITS mailboxes, as well as emails and phone calls notifying them of this information.

To complete the attestation form and for more information, visit the provider attestation section of the Transition Plan for Home and Community-Based Services webpage.

Providers that submitted their attestation and need to update

Providers who submitted their attestation with a response of “do not yet comply” for any requirement area need to update responses to “comply” or request a hardship extension. The deadline to submit an updated final attestation or hardship extension was Sept. 1, 2017. DHS will reach out in a separate communication to providers with attestations still marked “do not yet comply” who have not submitted a request for a hardship extension.

Please view the video Tutorial for updating your HCBS online attestation form.

New laws 2017

DHS proposed changes to existing DHS licensing and housing with services requirements that took effect May 31, 2017. Please see the “what’s new” section of the Transition Plan for Home and Community-Based Services webpage for detailed information.
