Dear Ms. Terlizzi:
CORRECTION ORDER
An investigation of LSS Grand Place was completed regarding report number 202202781 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D This maltreatment allegation concerned neglect. The disposition of the investigation report is false. Two violations were noted.
VIOLATION AND CORRECTION ORDER
The following violations of state and (or) federal laws and rules was observed. Corrective action for the violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.
1. Citation: Minnesota Statute, section 245D.071, subdivision 1.
Violation: For one person (P) whose record was reviewed, the license holder did not comply with the requirements in this section as required. a. The P’s Individual Abuse Program Plan (IAPP) was reviewed by the P’s interdisciplinary team on November 20, 2020. The license holder reported that the P’s IAPP was reviewed again on December 7, 2021, however, the license holder failed to document the review of the P’s IAPP in 2021, as required in subdivision 2.
b. The license holder failed to conduct the assessments required in subdivision 3, clauses (1) through (3) annually in 2021. Additionally, due to the license holder’s failure to conduct the assessments, the license holder failed to review the results of these assessments with the P and their support team in 2021.
c. The license holder failed to obtain dated signatures from the P, the P's legal representative, and the P’s case manager within twenty working days of the progress review meeting held on December 7, 2021.
Corrective Action Ordered: On an ongoing basis you must maintain compliance as required in this subdivision.
2. Citation: Minnesota Statute, section 245D.09, subdivision 4a, paragraph (a).
Violation: For three staff persons (SP1, SP2, and SP3) whose personnel file was reviewed, the license holder did not ensure that staff persons met orientation to individual service recipient needs as required.
The license holder failed to ensure that prior to having direct contact with the P, or any time the P’s plans and procedures were revised, that SP1-SP3 reviewed and received instruction on the P’s plans as they related to the staff person’s job functions for the P.
Corrective Action Ordered: On an ongoing basis you must maintain compliance with this licensing requirement throughout the program.
