Dear Mr. Elliott:
CORRECTION ORDER
An investigation of Bridges MN Duluth Ave was completed regarding report number 202204383 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned neglect. The disposition of the investigation report included an error in the provision of the therapeutic conduct to a vulnerable adult by a staff person, which was not maltreatment, and inconclusive as to facility responsibility. One violation was noted.
VIOLATIONS AND CORRECTION ORDERS
The following violation of state and (or) federal laws and rules was observed. Corrective action for the violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.
Citation: Minnesota Statutes section 245D.07, subdivision 1a, paragraph (a).
Violation: The license holder did not ensure services were provided in response to a person's identified needs, interests, preferences, and desired outcomes as specified in the coordinated service and support plan and the coordinated service and support plan addendum, and in compliance with the requirements of this chapter. License holders providing intensive support services must also provide outcome-based services according to the requirements in section 245D.071.
A consumer’s (C’s) coordinated service and support plan and coordinated service and support plan addendum, included 1) that the C required 2:1 staffing; 2) that if 2:1 staffing was unavailable, the C’s guardians would be notified; and 3) that staff would accompany the C in the community at all times.
On June 4, 2022, information was provided that the facility was unable to adequately staff the C’s 2:1 staffing; that no one from the facility contacted the C’s guardians about this; and that the C was left unsupervised in the community for “over 20 minutes.”
Repeat Violation: The license holder was cited for a similar violation in an Order of License Revocation, Determinations of Maltreatment, and Failure to Report Maltreatment dated June 27, 2022; and in correction orders dated December 29, 2017, June 14, 2019, August 19, 2020, and May 20, 2021.
Corrective Action Ordered: Because the license is currently revoked, operating under appeal, you must share this correction order with the person, the person’s legal representative, and the person’s case manager and inform each of how you will maintain compliance with this licensing requirement on a continuing basis.
If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
