CORRECTION ORDER

An investigation of Bar None Residential Services was completed regarding report number 202203218 which alleged violation of Minnesota Statutes, section 260E, and Minnesota Rules, parts 2960.0010 to 2960.0120 (CRF). This maltreatment allegation concerned neglect and physical abuse. The disposition of the investigation report is maltreatment not determined. One violation was noted.

VIOLATIONS AND CORRECTION ORDERS

The following violation of state and (or) federal laws and rules was observed. Corrective action for the violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.

Citation:  Minnesota Rules, part 2960.0710, subpart 6, items C and K.

Violation: The use and documentation of restrictive procedures implemented with a resident (R1) on April 3, 2022, did not meet requirements in the following ways:

a. Documentation of physical holds implemented at 7:04 PM and 7:12 PM did not identify the presence of an immediate threat to the physical safety of the resident or others and did not explain why the procedure needed to be used;

b. Documentation of the physical hold implemented at 7:12 PM indicated the physical hold ended when R1 was safely in the calming room, however, the physical hold continued for eight minutes after arriving to the calming room.  Documentation stated that the type of hold was transitioned at 7:14 PM for R1’s comfort, that R1 continually asked to be released without engaging in a de-escalation process, but did not contain any information indicating R1’s behavior posed a risk of imminent danger that required the physical hold to continue; and

c. The use of physical holding was not documented immediately after the incident concluded; the “Restrictive Procedures Report” was completed on April 5, 2022.

Corrective Action Ordered:  Immediately and on an ongoing basis, the license holder must ensure the use and documentation of restrictive procedures meets all applicable requirements.
