Dear Ms. Eriksmoen: CORRECTION ORDER
An investigation of The Cottages of Dakota Huron was completed regarding report number 202205682 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned neglect. The disposition of the investigation report is inconclusive. One violation was noted.
VIOLATIONS AND CORRECTION ORDERS
The following violation of state and (or) federal laws and rules was observed. Corrective action for the violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.
Citation: Minnesota statutes section 245D.07, subdivision 1a.
Violation: The license holder failed to provide services in response to a person’s (P) identified needs, interests, preferences, and desired outcomes as specified in the coordinated service and support plan and the coordinated service and support plan addendum.
On July 5, 2022, the P went to a medical appointment on his/her own, without staff assistance. The P’s Coordinated Service and Support Plan Addendum Summary stated that the P required assistance with appointment/transportation management. The Coordinated Services and Supports Plan stated that staff persons transport the P to medical appointments and “attend all appointments” with him/her. The P’s Intensive Support Self-Management Assessment stated that the P had no alone time in the community and staff persons were to be with the P at all times, with the exception of when the P attended his/her day program.
Additionally, on July 14, 2022, a staff person served the P whole pancakes. The P’s Coordinated Service and Support Plan Addendum Summary stated that the P required assistance with meal preparation, including cutting up his/her food into bite sized pieces and staff persons were to be “near” the P when s/he ate, due to his/her choking risks.
Corrective Action Ordered: Comply with 245D requirements related to the provision of services in accordance with the person’s coordinated service and support plan and the coordinated service and support plan addendum.

If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error.
