September 21, 2022 Marlys Ubben New Horizons Adoption Agency Inc. 302 South Grove St. PO Box 188 Blue Earth, MN 56013 License Number: 801698 (Rule 4) CORRECTION ORDER Dear Ms. Ubben: On August 24, 2022, a licensing review of New Horizons Adoption Agency Inc., was conducted to determine compliance with state and federal laws and rules governing the provision of child-placing agencies under Minnesota Rules, parts 9545.0755 through 9545.0845 (Rule 4). As a result of this licensing review, a Correction Order is being issued. A. Reason for Correction Order Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that an applicant or license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the applicant or license holder. The following violations of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services. 1. Citation: Minnesota Rules, part 9545.0805, subpart 3. Violation: The annual training requirement for staff must reflect an emphasis on children with special needs. 2. Citation: Minnesota Rules, part 9545.0835, subpart 2. Violations: In Adoption File 1, information showed that the family was currently licensed with a county agency. The home study assessment completed by New Horizons was not done in conjunction with the county agency. Additionally, it does not appear New Horizons contacted the county agency, and the original home study assessment and the home study update completed by the county were not in the adoption file. Corrective Action Ordered for Citations 1-2: Within 30 days of receipt of this order, submit evidence of corrective action taken to ensure ongoing compliance. If you fail to correct the violation specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07. Right to Request Reconsideration If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report.
