Dear Ms. Clark:

CORRECTION ORDER

An investigation of Your Home Care Services LLC was completed regarding report number 202206285 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned neglect. The disposition of the investigation report is inconclusive. Two violations were noted.

VIOLATIONS AND CORRECTION ORDERS

The following violations of state and (or) federal laws and rules were observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.

1. Citation: Minnesota Statutes 245D.05, subdivision 1.

Violation: For one of one persons whose records were reviewed [P], the license holder did not meet health service needs as assigned.

The license holder was assigned responsibility for meeting the health service needs for the P. The license holder maintained documentation in the P’s Coordinated Service and Support Plan Addendum, dated November 2, 2021, that the license holder was responsible for assisting with or coordinating medical, dental, and other health service appointments. The license holder failed to assist with or coordinate medical appointments.

The P was to see his/her psychiatrist on various dates as indicated by the psychiatrist. The P had scheduled appointments on February 14 and March 2, 2022. The license holder failed to bring the P to the scheduled appointments and there was no reason given as to why these were missed. Additionally, the P moved to a new facility on June 6, 2022, and had a previously scheduled psychiatrist on June 8, 2022. However, this information was not relayed to the new facility, causing the P to miss this appointment.

2. Citation: Minnesota Statutes, section 245D.081

Violation: The license holder did not meet the requirements of program coordination, evaluation, and oversight.

a. The license holder failed to ensure that the designated coordinator (DC), provided coordination of service delivery and evaluation for each person served by the program. See citation 1, for the designated coordinators failure to provider supervision, support, and evaluation of activities, including oversight of the license holder’s responsibilities assigned in the person’s CSSP and CSSP addendum.

b. The license holder failed to ensure that the designated manager (DM) provided program management and oversight of the services provided by the license holder. See citation 1 for the designated manager’s failure to:

· maintaining a current understanding of the licensing requirements sufficient to ensure compliance throughout the program as identified in section 245A.04, subdivision 1, paragraph (e), and when applicable, as identified in section 256B.04, subdivision 21, paragraph (g); and

· ensuring the duties of the designated coordinator are fulfilled according to the requirements in subdivision 2.

If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
