CORRECTION ORDER
Dear Blake Elliott:
A licensing complaint investigation of Bridges MN, located at 1932 University Avenue West Saint Paul, Minnesota was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of the licensing complaint investigation(s) a Correction Order is being issued.
A. Reason for Correction Order
Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder.
The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services.
1. Citation: Minnesota Statues, section 245A.65, subdivision 2, paragraph (b).
Violation: For one person whose record was reviewed (P1), the license holder did not meet the requirements for an individual abuse prevention plan (IAPP) as required.
Minnesota Statutes, section 245A.02, subdivision 2b defines “annual” or “annually” to mean prior to or within the same month of the subsequent calendar year.
The license holder failed to review P1’s IAPP at least annually with P1’s interdisciplinary team. P1’s IAPP was reviewed on September 3, 2020. The license holder did not review P1’s IAPP with the interdisciplinary team again until August 29, 2022.
Repeat Violation: The license holder was cited for a similar violation in an Order of License Revocation, Determinations of Maltreatment, and Failure to Report Maltreatment dated June 27, 2022; and in correction orders dated February 25, 2022, December 6, 2021, June 14, 2019, and June 22, 2018.
Corrective Action Ordered: Because the license is currently revoked, operating under appeal, within 30 days, you must:
· share this correction order with the person, and the person’s case manager;
· and inform each of how you will maintain compliance with this licensing requirement on a continuing basis; and
· submit, to the licensor identified in this correction order, evidence showing that the above mentioned requirements have been completed.
2. Citation: Minnesota Statutes 245D.06, subdivision 4, paragraph (a).
Violation: For one person whose record was reviewed (P1), the license holder did not meet all requirements for safeguarding and handling a person’s funds as required.
The license holder failed to obtain written authorization from P1 and P1’s case manager to assist P1 with the safekeeping for funds on an annual basis.
Although the license holder obtained written authorization from P1’s legal representative and case manager on September 3, 2020, the license holder did not obtain written authorization in 2021. The license holder later obtained authorization from P1 (P1 is now their own legal representative) and P1’s case manager on August 29, 2022.
Repeat Violation: The license holder was cited for a similar violation in an Order of License Revocation, Determinations of Maltreatment, and Failure to Report Maltreatment dated June 27, 2022; and in a correction order dated June 14, 2019.
Corrective Action Ordered: Because the license is currently revoked, operating under appeal, within 30 days, you must:
· share this correction order with the person, and the person’s case manager;
· and inform each of how you will maintain compliance with this licensing requirement on a continuing basis; and
· submit, to the licensor identified in this correction order, evidence showing that the above mentioned requirements have been completed.
3. Citation: Minnesota Statutes, section 245D.04, subdivision 1, paragraph (1).
Violation: For one person whose record was reviewed (P1), the license holder did not provide a written notice that identified the service recipient rights as required.
The license holder failed to provide P1 with a notice and explanation of the service recipient rights annually. The license holder provided P1’s legal representative with a written notice on September 3, 2020. The license holder did not provide P1 with a notice in 2021. The license holder later provided P1 with a written notice on August 29, 2022.
Repeat Violation: The license holder was cited for a similar violation in an Order of License Revocation, Determinations of Maltreatment, and Failure to Report Maltreatment dated June 27, 2022; and in correction orders dated June 14, 2019 and February 25, 2021.
Corrective Action Ordered: Because the license is currently revoked, operating under appeal, within 30 days, you must:
· share this correction order with the person, and the person’s case manager;
· and inform each of how you will maintain compliance with this licensing requirement on a continuing basis; and
· submit, to the licensor identified in this correction order, evidence showing that the above mentioned requirements have been completed.
4. Citation: Minnesota Statutes, section 245D.071, subdivision 3, paragraph (b).
Violation: For one person whose record was reviewed (P1), the license holder did not meet service planning and assessment for intensive services as required.
The license holder failed to complete assessments for P1 on an annual basis. The license holder completed assessments for P1 in the following areas on September 3, 2020. The license holder did not complete the assessments for P1 in 2021. The license holder later completed the assessments for P1 on August 29, 2022: · the person's ability to self-manage health and medical needs to maintain or improve physical, mental, and emotional well-being, including, when applicable, allergies, seizures, choking, special dietary needs, chronic medical conditions, self-administration of medication or treatment orders, preventative screening, and medical and dental appointments;
· the person's ability to self-manage personal safety to avoid injury or accident in the service setting, including, when applicable, risk of falling, mobility, regulating water temperature, community survival skills, water safety skills, and sensory disabilities; and
· the person's ability to self-manage symptoms or behavior that may otherwise result in an incident as defined in section 245D.02, subdivision 11, clauses (4) to (7), suspension or termination of services by the license holder, or other symptoms or behaviors that may jeopardize the health and welfare of the person or others.
Repeat Violation: The license holder was cited for a similar violation in a correction order dated June 14, 2019.
Corrective Action Ordered: Because the license is currently revoked, operating under appeal, within 30 days, you must:
· share this correction order with the person, and the person’s case manager;
· and inform each of how you will maintain compliance with this licensing requirement on a continuing basis; and
· submit, to the licensor identified in this correction order, evidence showing that the above mentioned requirements have been completed.
5. Citation: Minnesota Statutes, section 245D.071, subdivision 5, paragraph (a).
Violation: For one person whose record was reviewed (P1), the license holder did not meet the requirements for service plan review and evaluation as required.
The license holder failed to meet with P1, P1’s case manager and other members of the support team at least annually. The license holder met with P1 and P1’s support team on September 3, 2020 and on August 29, 2022.
Repeat Violation: The license holder was cited for a similar violation in an Order of License Revocation, Determinations of Maltreatment, and Failure to Report Maltreatment dated June 27, 2022; and in a correction order dated November 9, 2021.
Corrective Action Ordered: Because the license is currently revoked, operating under appeal, within 30 days, you must:
· share this correction order with the person, and the person’s case manager;
· and inform each of how you will maintain compliance with this licensing requirement on a continuing basis; and
· submit, to the licensor identified in this correction order, evidence showing that the above mentioned requirements have been completed.
6. Citation: Minnesota Statutes 245D.081, subdivision 2.
Violation: The license holder did not ensure the designated coordinators provided coordination of the service delivery and evaluation of the services provided by the license holder as required.
The license holder did not hold a service planning and review meeting on an annual basis for P1. P1’s last service planning and review meeting had occurred on September 3, 2020. When a DHS licensor asked SP1 about this on August 2, 2022, SP1 stated that at around the time P1’s annual meeting was due in 2021, the oversight of P1’s services was assigned to a different designated coordinator and P1’s meeting was missed due to this change. At the time of the on-site complaint investigation on August 2, 2022, P1 had not had a meeting since September 3, 2020. The license holder later held a service planning and review meeting for P1 on August 29, 2022. The designated coordinator identified by the license holder failed to provide oversight to ensure P1’s services were delivered as required, including conducting service planning and review meetings.
Repeat Violation: The license holder was cited for a similar violation in an Order of License Revocation, Determinations of Maltreatment, and Failure to Report Maltreatment dated June 27, 2022; and in correction orders dated October 14, 2022, May 20, 2021, and June 14, 2019.
Corrective Action Ordered: Because the license is currently revoked, operating under appeal, within 30 days, you must:
· share this correction order with the person, and the person’s case manager;
· and inform each of how you will maintain compliance with this licensing requirement on a continuing basis; and
· submit, to the licensor identified in this correction order, evidence showing that the above mentioned requirements have been completed.
If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.

B. Right to Request Reconsideration
If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report. Your request for reconsideration must be sent to:

Please note that a request for reconsideration does not stay any provisions or requirements of the Correction Order. The Commissioner’s disposition of a request for reconsideration is final and not subject to appeal under Minnesota Statutes, chapter 14.
