CORRECTION ORDER

Dear Terri Skoog-Anderson:

On November 1, 2022 a Department of Human Services (DHS) licensor conducted a licensing review at your facility located at 93 Main Street, Clinton MN. As a result of this visit, DHS determined that you are in violation of two of the 245D rules and statutes. As a result, DHS is issuing this order which requires you to take the correction action as described under each violation. Details of our findings are provided below. Our next steps and your options are also detailed.

LICENSING VIOLATIONS

DHS determined that your program failed to follow licensing rules and statutes, as described below.

SERVICE RECIPIENT

1. Violation: For two of two persons whose records were reviewed (P1 and P2), the license holder did not provide the person or their legal representatives with a written notice that identified the service recipient rights as required.

The license holder provided P1 and P2 with a notice that identified service recipient rights and explaintation of those rights as required within five working days of service initiation and annually thereafter however, the license holder failed to provide a notice that identified the service recipient right of: access to the person’s personal possessions at any time, including financial resources.

Statute Violated: section 245D.04, subdivision 3, paragraph (a). 

Corrective Action Required: Within 15 days of receiving this order, you must update your program’s service recipient rights notice. Within 30 days of receiving this order, you must provide the updated notice to all persons currently receiving services and their legal representatives (if applicable). On an ongoing basis, you must maintain compliance as required in this subdivision.

2. Violation: For one person (P1), the license holder did not provide services in response to P1’s identified needs, interests, preferences, and desired outcomes as specified in the support plan and support plan addendum.

P1’s identified needs and interests were being social at work, completing art projects, trying new things and enjoying animals. The license holder identified P1’s outcomes as:

· Daily after lunch, with one verbal prompt, P1 will request a job coach to place their dishes in the dirty dish tub.

· Daily at med. time, with two or less verbal prompt, P1 will come to the medication room to take their medication.

· P1 will return to the work area after one verbal prompt.

· Daily after completing their lunch, with one verbal prompt, P1 will cue their job coach for a wet wipe to wash their hands and face.

Statute Violated: section 245D.07, subdivision 1a

Corrective Action Required: Within 30 days of receiving this order you must:

· submit a written plan documenting how you will develop P1’s service outcomes and supports to meet the requirements in the above mentioned subdivisions, including the timeline for meeting with P1 and ,P1’s support team.

Within 90 calendar days, you must:

· audit all service recipient records to ensure the requirements found in 245D.07, subdivision 1a are met; and

· updated as needed, the service recipient records to include person-centered service planning and delivery that:

o identifies and supports what is important to the person as well as what is important for the person, including preferences for when, how, and by whom direct support service is provided;

o uses that information to identify outcomes the person desires; and

o respects each person's history, dignity, and cultural background.

On an ongoing basis, you must maintain compliance as required in this subdivision.

Within the timelines defined in this order above, submissions required as part of a corrective action ordered must be submitted to your licensor:

YOUR RIGHT TO REQUEST RECONSIDERATION

You have the right to request reconsideration of this order and the cited violations. Your request must:

· Be in writing

· List each violation you are challenging and identify what is inaccurate or incomplete about the information in the order

· Supply information that is accurate or more complete

· Be made before the deadlines provided below

If you are mailing your request, it must be received by DHS within 20 calendar days from when you received this order. If you do not meet this deadline, you lose your right to request reconsideration. The timeline to appeal began when you received this order. Please send it to:
