CORRECTION ORDER

Dear Blake Elliott:

On November 9, 2022, a licensing complaint investigation of Bridges MN located at 13770 Frontier Court Suite 110, Burnsville, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing complaint investigation a Correction Order is being issued.

A. Reason for Correction Order

Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder.

The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services.

1. Citation: Minnesota Statutes, section 245D.07, subdivision 1a.

Violation: For one of one person whose record was reviewed (P1), the license holder did not provide services in response to the person’s identified needs as required.

P1’s coordinated service support plan addendum dated June 28, 2022, stated P1 had alone time in the community for pre-approved locations and pre-approved times. The license holder stated P1’s team would have to approve the time and location prior to having alone time. On October 10, 2022, SP1 transported P1 to their dentist appointment at approximately 1:30 PM and left. SP2 was a supervisor and approved SP1 to leave P1 unsupervised at the dentist because the appointment occurred during a shift change. The staff person arriving at 3:00 PM was to pick P1 up at the dentist. SP2 did not get approval from the team prior to leaving P1 unsupervised as the dentist.

Corrective Action Ordered: Within 30 days of this order, because the license is currently revoked, operating under appeal, you must share this correction order with the person, the person’s legal representative, and the person’s case manager and inform each of them how you will maintain compliance with this licensing requirement on a continuing basis. On an ongoing basis, you must maintain compliance as required with this subdivision.

2. Citation: Minnesota Statutes, section 245D.09, subdivision 4a.

Violation: For one of two staff persons whose record was reviewed (SP2), the license holder did not provide orientation training as required.

The license holder hired SP2 on April 22, 2022. SP2 was in a supervisory role for P1’s services starting in September 2022. SP2 did not receive training on P1’s coordinated service support plan when SP2 began working with P1. The license holder trained SP2 on November 7, 2022.

Corrective Action Ordered: Within 30 days of this order, because the license is currently revoked, operating under appeal, you must share this correction order with the person, the person’s legal representative, and the person’s case manager and inform each of them how you will maintain compliance with this licensing requirement on a continuing basis. On an ongoing basis, you must maintain compliance as required with this subdivision.

B. Right to Request Reconsideration

If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report. Your request for reconsideration must be sent to:

Please note that a request for reconsideration does not stay any provisions or requirements of the Correction Order. The Commissioner’s disposition of a request for reconsideration is final and not subject to appeal under Minnesota Statutes, chapter 14.

C. Posting the Correction Order

Pursuant to Minnesota Statutes, section 245A.06 subdivision 8, you must post this Correction Order for two years in a place that is conspicuous to the people receiving services and all visitors to the facility, even if you request reconsideration.
