Summary of Final Decision of Commissioner:
1. The revocation of Primrose School of Arden Hills and Shoreview’s child care facility license is RESCINDED;
2. Primrose School shall pay a FINE in the amount of $200;
3. Primrose School (hereinafter, Primrose) shall operate with a CONDITIONAL LICENSE for a period of one year from the date of this order, subject to the following conditions: a. Primrose shall maintain full compliance with all Minnesota Rules and Statutes governing licensure. b. Primrose shall, in full compliance with Minnesota Statutes, section 245A.04, subdivision 5(a), ensure that the Commissioner is given access to: i. the physical plant and grounds where the program is provided; ii. documents and records, including records maintained in electronic format; iii. persons served by the program; and iv. staff and personnel records of current and former staff. c. Primrose shall, in full compliance with Minnesota Statutes, section 245C.02, subdivision 6a(a), clause (1) or (5), ensure that a background study is conducted on any volunteer, contractor, prospective employee, or other individual who has unsupervised physical access to a child served by its program and who is not under supervision by a qualified individual as such is defined in statute. d. Alternatively, for any individual who is not part of Primrose’s child care program and who is providing services on Primrose’s premises, Primrose shall ensure compliance with the following requirements: i. the child receiving services is signed out of the child care program for the duration that the services are provided; ii. Primrose has obtained advanced written permission from the parent authorizing the child to receive the services, which is maintained in the child's record; iii. Primrose maintains documentation on site that identifies the individual service provider and the services being provided; and iv. Primrose ensures that the service provider does not have unsupervised access to a child not receiving the provider's services. e. Appellant shall submit to the Commissioner by December 30, 2022, a background study on outside service providers or a written plan for ensuring the safety of children receiving services by contractors or outside providers. The plan must include: i) the name of each service provider; ii) documentation constituting written permission from the parent authorizing the child to receive the services; and iii) a description for how Primrose will ensure the provider has access to no other child. Pursuant to Minnesota Statute § 254A.06, subd. 8, the complete Order of Conditional License shall be posted for two years, from the date received, in a place that is conspicuous to all persons receiving services and all visitors. g. The Department will monitor compliance with the terms of this conditional license Order and with all Minnesota Statutes and Rules. The monitoring will include periodic unannounced visits to Primrose School of Arden Hills and Shoreview. Failure to comply with these terms and conditions or any other provisions of law may result in additional negative actions against the license, including revocation.
