CORRECTION ORDER

Dear Blake Elliott,

On November 16, 2022 a Department of Human Services (DHS) licensor conducted a licensing investigation. As a result of this visit, DHS determined that you are in violation of one of the 245D-Home and Community Based rules and statutes. As a result, DHS is issuing this order which requires you to take the correction action as described below. Details of our findings are provided below. Our next steps and your options are also detailed.

LICENSING VIOLATIONS

DHS determined that your program failed to follow licensing rules and statutes, as described below.

SERVICE RECIPIENT

Violation: The license holder did not provide services as written in P1’s support plan.

The license holder failed to provide services as required in P1’s support plan. According to the support plan, P1 is required to have 2 staff 16 hours a day.

On October 7, 2022 P1 was without 2 staff from 2:46PM-10:00PM.

Statute Violated: section 245D.07, Subdivision 1.

Repeat Violation: In a Correction Order that DHS issued on June 14, 2019, August 28, 2019, March 10, 2020; March 12, 2020, May 20, 2021, December 6, 2021, February 25, 2022 and June 3, 2022 you were previously found in violation of this same statute.

Corrective action required

Because the licnese is currently revoked, operating under appeal, you must share this correction order with the person, the persons’s legal representative, and the person’s case manager and inform each of how you will maintain compliance with this licensing requirement on a continuing basis.

· List each violation you are challenging and identify what is inaccurate or incomplete about the information in the order

· Supply information that is accurate or more complete

· Be made before the deadlines provided below
