CORRECTION ORDER

Dear Blake Elliott:

On November 30, 2022, a Department of Human Services (DHS) licensor conducted a licensing investigation at your facility located at 1932 University Ave West, Saint Paul Minnesota. As a result of this visit, DHS determined that you are in violation of two, 245D Home and Community Based Services rules and statutes. As a result, DHS is issuing this order, which requires you to take the corrective action as described below. Details of our findings are provided below. Our next steps and your options are also detailed.

LICENSING VIOLATIONS

DHS determined that your program failed to follow licensing rules and statutes, as described below.

Service Recipient

1. Violation: The license holder did not ensure P1 took medication as prescribed.

The license holder was responsible for medication administration for P1. The license holder failed to ensure P1 took their prescribed medication.

P1 was prescribed medication for seizures twice a day. The license holder administered P1’s medication on the morning of October 8, 2022 and not again until the evening of October 10, 2022, resulting in P1 missing four doses.

Statute Violated: 245D.05, Subdivision 2, paragraph (b).

Repeat Violation: In Correction Orders that DHS issued on March 10, 2020, October 7, 2020, February 5, 2021, April 2, 2021, November 9, 2021 and November 22, 2022; you were previously found in violation of this same statute.

Program policies and procedures

2. Violation: The license holder did not implement the programs safe medication assistance and administration policy as written.

The license holder failed to check P1’s medication routinely to ensure an adequate amount of medication for administration.

On October 8, 2022, P1 was provided a 7AM dose of seizure medication as prescribed. On October 9, 2022, it was discovered P1 was out of seizure medication. Staff attempted to refill the prescription, but was not successful as the pharmacy was closed. P1’s seizure medication was refilled on October 10, 2022 and P1 was able to receive the 8PM dose.

P1 missed four doses of medication.

Statute Violated: 245D.11, subdivision 2, paragraph (3).

Repeat Violation: In Correction Orders that DHS issued on February 5, 2021 and February 25, 2022 you were previously found in violation of this same statute.

Corrective action required

Because the license is currently revoked, operating under appeal, within 30 days you must share this correction order with the person, the person’s legal representative (if applicable) and the person’s case manager. You must inform each, how you will maintain compliance with this licensing requirement on a continuing basis. On an ongoing basis, you must ensure medications are provided as prescribed and all applicable policies and procedures are followed as required.

· List each violation you are challenging and identify what is inaccurate or incomplete about the information in the order

· Supply information that is accurate or more complete
