CORRECTION ORDER
Dear Blake Elliott: On December 8, 2022, a Department of Human Services (DHS) licensor conducted a licensing investigation at your facility located at 1932 University Ave. West, Saint Paul. As a result of this visit, DHS determined that you are in violation of one of the Home and Community Based rules and statutes. As a result, DHS is issuing this order, which requires you to take the correction action as described below. Details of our findings are provided below. Our next steps and your options are also detailed. LICENSING VIOLATIONS
DHS determined that your program failed to follow licensing rules and statutes, as described below. Service Recipient
1. Violation: For P1, the license holder did not provide services that complied with the requirements of chapter 245D and the federal waiver guidelines.
In a document titled, “Coordinated Services and Support Plan Addendum-Intensive Services” dated July 18, 2022 and August 23, 2002, the license holder was responsible for providing P1 Individualized Home Supports with training (IHS with training) and Night Supervision. Through a review of the program’s surveillance videos, it was observed that staff failed to provide IHS with training as defined in the federal waiver plan. For example, on August 2, 2022, staff were observed on their personal cell phone, laying on the couch and not providing services as required during their shift. Statute Violated: 245D.07, Subdivision 1
Corrective action required
Because the license is currently revoked, operating under appeal, within 30 days, you must: · share this correction order with the person, and the person’s case manager;
· and inform each of how you will maintain compliance with this licensing requirement on a continuing basis.
On an ongoing basis, you must provide services as written in the support plan and as defined in federal waiver plans. YOUR RIGHT TO REQUEST RECONSIDERATION
