Dear Mr. Feltz:
CORRECTION ORDER
An investigation of Community Living Options - Homestead House/ Community Living Options was completed regarding report number 202208379 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned financial exploitation. The disposition of the investigation report is substantiated. Four violations were noted.
VIOLATIONS AND CORRECTION ORDERS
The following violations of state and (or) federal laws and rules were observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.
1. Citation: Minnesota Statutes, section 245A.65, subdivision 2 paragraph (b).
Violation: For one person whose record was reviewed (P1), the license holder did not review the individual abuse prevention plan as required. The license holder reviewed P1’s individual abuse prevention with P1 interdisciplinary team in March 2021; however the license hold failed to review this plan with P1’s individual abuse prevention plan with P1’s interdisciplinary team since March 2021. Corrective Action Ordered: Within 30 days of receipt of this order, you must review P1’s individual abuse prevention plan with interdisciplinary team. On an ongoing basis, you must review individual abuse prevention as required in this subdivision.
2. Citation: Minnesota Statute, section 245D.071, subdivision 5 paragraph (a).
Violation: For one person whose record was reviewed P1, the license holder did not review the coordinated service and support plan addendum as required. The license holder reviewed and evaluate P1’s coordinated service and support plan addendum with P1 support team in March 2021; however the license hold failed to review and evaluate this plan with P1’s coordinated service and support plan addendum with P1’s interdisciplinary team since March 2021. Corrective Action Ordered: Within 30 days of receipt of this order, you must review P1’s coordinated service and support plan addendum with interdisciplinary team. On an ongoing basis, you must review P1’s coordinated service and support plan addendum as required in this subdivision.
3. Citation: Minnesota Statute, section 245D.07, subdivision 1, paragraph (a).
Violation: For two persons served (P1 and P2), the license holder failed to provide services based on persons’ identified needs. The two persons served required a supervisory staff person to manage and balance their bank accounts monthly; however, the license holder failed to provide these services for the months of June through October 2022. Corrective Action Ordered: On an ongoing basis, you must maintain compliance with this licensing requirement throughout the program.
4. Citation: Minnesota Statute, section 626.557, subdivision 3, paragraph (a).
Violation: The license holder did not report maltreatment as required.
On October 8, 2022, a supervisory staff person was aware of an incident of alleged maltreatment. The license holder failed to make a report to the Minnesota Adult Abuse Reporting Center until October 10, 2022.
Corrective Action Ordered: On an ongoing basis, you must maintain compliance with this licensing requirement throughout the program.
If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter. You must include any and all information, documentation, or other evidence you have to support your request for reconsideration. Please note that a request for reconsideration does not stay any provisions of the correction order.
