CORRECTION ORDER

An investigation of At Home Living Facilities, Inc. was completed regarding report number 202205879 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned neglect. The disposition of the investigation report is inconclusive. One violation was noted.

VIOLATION AND CORRECTION ORDER

The following violation of state and (or) federal laws and rules was observed. Corrective action for the violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violation within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.

Citation: Minnesota Statutes, section 245A.65, subdivision 1.

Violation: The license holder did not enforce written policies and procedures related to suspected or alleged maltreatment as required.

The license holder failed to complete an internal review within 30 calendar days of knowing that a report of alleged or suspected maltreatment was made, including:

· an evaluation of whether related policies and procedures were followed;

· whether the policies and procedures were adequate;

· whether there is a need for additional staff training;

· whether the reported event is similar to past events with the vulnerable adults or the services involved; and

· whether there is a need for corrective action by the license holder to protect the health and safety of vulnerable adults.

On August 22, 2022, a DHS investigator requested that At Home Living Facilities Inc., submit a copy of its internal review pertaining to report number 202205879 to DHS. Subsequent requests for the internal review occurred on December 6, 2022, and January 11, 2023; however, the license holder failed to submit a copy of its internal review.

Corrective Action Ordered: Immediately, you must complete an internal review as detailed above. On an ongoing basis, you must maintain compliance as required in this subdivision.

If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
