Terms of Settlement Agreement:

DHS agrees to stay the $1800 fine for a period of two years from the date of execution. The fine will be waived in full after the two-year stay if License Holder complies with the terms of this settlement agreement and follows all family child care rules and regulations.

The License Holder’s family child care license shall be placed on conditional status for a period of two years from the effective date of this Settlement Agreement.  While under the conditional license, the License Holder shall comply with the following terms:

a. Follow and comply with all applicable Minnesota Rules and Laws.

b. No variances to age distribution or capacity will be granted during the conditional period.

c. Submit a written plan to Kanabec County as to how the program will ensure that all caregivers, helpers, substitutes, and employees will complete required background studies and trainings prior to providing care. The plan must be submitted to Kanabec County within three weeks of the date of execution of this settlement agreement.

d. Prior to a new caregiver providing care to children, License Holder will notify Kanabec County of the new caregiver and provide the following documentation to Kanabec County for the caregiver in a timely manner:

i. Cleared background study

ii. Completed physicians report

iii. Proof of completed required CPR and first aid training

iv. Proof of completed SUID and AHT training

v. Proof of completed Supervising for Safety training

vi. Proof of completed Child Development and Learning and Behavior Guidance training

vii. Verification that the caregiver has been trained on the program’s drug and alcohol policy.

viii. Verification that the caregiver has been trained on the program’s grievance policy

e. Submit a written plan to Kanabec County about how new and current caregivers and employees will be trained on Minnesota family child care rules and statutes. The plan must also include how License Holder will verify that a new caregiver has been trained prior to caring for children. The plan must be submitted to Kanabec County within three weeks of the date of execution of this settlement agreement.

f. Notify Kanabec County by email or phone call within five days of a change in a caregiver or employee’s status, including termination of a caregiver or employee, or a change in the caregiver or employee’s hours of care provided. If there is a change in the primary provider of care, License Holder must notify Kanabec County prior to the change taking place.

g. Submit a written plan as to how License Holder will ensure that caregiver and employee personnel files are accessible and maintained according to licensing requirements. The plan must be submitted to Kanabec County within three weeks of the date of execution of this settlement agreement.

h. Submit a plan within 30 day of this order about how the program will ensure that the basement of the program will become and remain safe and free of standing water and mold.

i. Either provide a copy of the Order to Pay a Fine and Order of Conditional License to parents of children in care or document that all parents have been given an opportunity to review the Order. Obtain parent signatures of each currently enrolled child, indicating they have either received a copy of the Order or had an opportunity to review the Order. Provide this documentation to Kanabec County within three weeks of the date of execution of this settlement agreement. For new families, submit documentation of compliance with this term to Kanabec County within 5 days of any child’s admission to your child care program.
