February 3, 2023 Monica Schmidt, Authorized Agent AbleLight 1600 Arboretum Boulevard Victoria, MN 55386 RE: Report No. 202209242 AbleLight License No. 1096896/1070397 Dear Ms. Schmidt: CORRECTION ORDER An investigation of 202209242 was completed regarding report number 202204383 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned neglect. The disposition of the investigation report is inconclusive. Two violations were noted. VIOLATIONS AND CORRECTION ORDERS The following violations of state and (or) federal laws and rules were observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07. 1. Citation: Minnesota Statutes section 245A.65, subdivision 2, paragraph (b). Violation: The license holder did not develop an individual abuse prevention plan as part of a person’s initial individual program plan or service plan. On October 1, 2022, a person (P) moved into the facility, but an individual abuse prevention plan was not developed for the P until November 10, 2022. Corrective Action Ordered: Maintain compliance with this licensing requirement on a continuing basis throughout the program. 2. Citation: Minnesota Statutes section 245D.05, subdivision 1, paragraph (b). Violation: The license holder did not develop procedures regarding their responsibilities to meet a person’s health service needs. On October 1, 2022, the P moved into the facility. On November 3, 2022, the P was taken by staff to an urgent care facility, and at that time, the facility had yet to develop procedures regarding their responsibilities to meet the P’s health service needs. On November 10, 2022, these plans were developed by the facility. Corrective Action Ordered: Maintain compliance with this licensing requirement on a continuing basis throughout the program. If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
