Terms of Settlement Agreement:
1. The License Holder’s family child care license shall be placed on conditional status for a period of six months from the effective date of this Settlement Agreement. While under the conditional license, the License Holder shall comply with the following terms:
a. Follow and comply with all applicable Minnesota Rules and Laws.
b. No variances to age distribution or capacity will be granted during the conditional period.
c. License Holder must obtain a family child care coach or mentor that has been approved by the County within 20 days of execution of this settlement agreement. She must actively work with her coach or mentor for the duration of the conditional license period.
d. License Holder must complete six hours of additional training. Two of the hours shall be in the area of Sudden Unexplained Infant Death (SUID)/Abusive Head Trauma (AHD). Four of the hours may be completed through working with the approved coach or mentor. This training is in addition to any required annual training. The training must be completed before the six-month conditional license period expires.
e. Submit a written plan to Hennepin County as to how the program will ensure that all caregivers, helpers, substitutes, and employees will complete required trainings prior to providing care, including but not limited to SUID, AHT and a review of License Holder’s emergency plan and how to notify parents in the event of an emergency. The plan must be submitted to Hennepin County within 60 days of the date of execution of this settlement agreement. License Holder must comply with the approved caregiver training plan.
f. License Holder will submit documentation to Hennepin County verifying that each existing caregiver has completed their required training within three weeks of the date of execution of this settlement agreement. License Holder will submit documentation of completed training for new caregivers before they care for children.
g. License Holder will ensure that all substitute caregivers are adults.
h. License Holder will maintain a clean, safe, and hazard-free environment.
i. License Holder will immediately post emergency contact phone numbers phone numbers of the parents of children served by the program. License Holder will ensure alternative caregivers are aware of how to notify parents in the event of an emergency.
j. License Holder will either provide a copy of the Order to Pay a Fine and Order of Conditional License to parents of children in care or document that all parents have been given an opportunity to review the Order. License Holder will obtain parent signatures of each currently enrolled child, indicating they have either received a copy of the Order or had an opportunity to review the Order. License Holder will provide this documentation to Hennepin County within three weeks of the date of execution of this settlement agreement. For new families, License Holder will submit documentation to Hennepin County within five days of any child’s admission to License Holder’s child care program.
2. The $600 fine is stayed for six months.
