CORRECTION ORDER
Dear Blake Elliott: On March 10, 2023 a Department of Human Services (DHS) licensor conducted a licensing investigation. As a result of this visit, DHS determined that you are in violation of one of the 245D-Home and Community Based Services rules and statutes. As a result, DHS is issuing this order which requires you to take the correction action as described below. Details of our findings are provided below. Our next steps and your options are also detailed. LICENSING VIOLATIONS
DHS determined that your program failed to follow licensing rules and statutes, as described below. Service Recipient
Violation: For one of one person whose record was reviewed (P1), the license holder did not provide services in response to P1’s identified needs as specified in P1’s support plan addendum. On August 3, 2022, P1 fell while outside while alone. P1 reported they knocked on the window and yelled for staff assistance, however SP1 was sleeping on the couch and unable to hear P1 to provide immediate assistance. During an interview with SP2, it was determined that SP1 did not follow P1’s support plan. Statute Violated: 245D.07, Subdivision 1a, paragraph (a).
Repeat Violation: In a Correction Order that DHS issued on December 10, 2021 and November 16, 2022 you were previously found in violation of this same statute. Corrective Action Required: On an ongoing basis, you must ensure support plans are implemented as required. YOUR RIGHT TO REQUEST RECONSIDERATION
