CORRECTION ORDER
Dear Blake Elliott: On March 10, 2023 and March 13, 2023, a Department of Human Services (DHS) licensor conducted a licensing investigation of your program. As a result of this investigation, DHS determined that you are in violation of one of the 245D-Home and Community Based Services rules and statutes. As a result, DHS is issuing this order which requires you to take the correction action as described below. Details of our findings are provided below. Our next steps and your options are also detailed. LICENSING VIOLATIONS
DHS determined that your program failed to follow licensing rules and statutes, as described below. Service Recipient
1. Violation: For two of two persons whose records were reviewed (P1 and P2), the license holder did not provide services in response to the person’s identified needs as specified in the support plan addendum.
· On September 25, 2022, SP1 was reported as sleeping from 2:30A-3:00A. SP1 was the only staff working in the home at the time.
· P1’s “Coordinated Service and Support Plan Addendum” dated August 16, 2022, states P1 requires the presence of staff at the service site.
· P2’s “Coordinated Service and Support Plan Addendum” dated June 29, 2022, states P2 “does not have any alone time at home”.
· During an interview on March 10, 2023, SP2 stated “no”, when asked if P1 and P2’s support plans were followed when staff were found to be sleeping.
· SP1 no longer works for the program.
Statute Violated: 245D.07, Subdivision 1a, paragraph (a).
Repeat Violation: In a Correction Order that DHS issued on December 10, 2021, November 16, 2022 and March 13, 2023 you were previously found in violation of this same statute. Corrective Action Required: On an ongoing basis, you must ensure support plans are implemented as required. YOUR RIGHT TO REQUEST RECONSIDERATION
