CORRECTION ORDER
Dear Blake Elliott: On March 10, 2023, and March 14, 2023, a Department of Human Services (DHS) licensor conducted a licensing investigation. As a result of this visit, DHS determined that you are in violation of one of the 245D-Home and Community Based Services rules and statutes. As a result, DHS is issuing this order which requires you to take the correction action as described below. Details of our findings are provided below. Our next steps and your options are also detailed. LICENSING VIOLATIONS
DHS determined that your program failed to follow licensing rules and statutes, as described below. Service Recipient Health Needs
1. Violation: For one of one person whose record was reviewed (P1), the license holder did not provide medication administration as required.
· P1’s “Coordinated Services and Support Plan Addendum” assigned responsibility of medication administration to the program. P1’s support plan shows, “P1 will be 100% dependent on staff to get their medications ready and administer at the appropriate times.”
· On October 5, 2022, program staff accompanied P1 to a medical appointment. At this appointment P1’s prescriber discontinued, Benztropine and Haloperidol effective immediately.
· Benztropine and Haloperidol were administered to P1 at 8PM on October 5, 2023; 1PM on October 6, 2023; 8PM on October 6, 2023 and at 1PM on October 7, 2023.
Statute Violated: 245D.05, Subdivision 2, paragraph (b), clause (1).
Corrective Action Required: On an ongoing basis, you must ensure medications or treatments are administrated as prescribed. 2. Violation: For P1, the license holder did not maintain medication administration records as required.
On October 5, 2023, P1’s prescriber discontinued Benztropine and Haloperidol. Program staff failed to update the medication administration record to indicate this discontinuation. Statute Violated: 245D.05, Subdivision 2, paragraph (c), clause (6).
Corrective Action Required: On an ongoing basis, you must ensure medications or treatments are administrated as prescribed. YOUR RIGHT TO REQUEST RECONSIDERATION
