CORRECTION ORDER

Dear Blake Elliott:

On March 10, 2023, and March 16, 2023, a Department of Human Services (DHS) licensor conducted a licensing investigation involving your program. As a result of this investigation, DHS determined that you are in violation of one of the 245D Home and Community Based Services rules and statutes. As a result, DHS is issuing this order which requires you to take the correction action as described under each violation. Details of our findings are provided below. Our next steps and your options are also detailed.

LICENSING VIOLATIONS

DHS determined that your program failed to follow licensing rules and statutes, as described below.

Service Recipient Needs

Violation: For one of one person whose record was reviewed (P1), the license holder did not provide services in response to the person’s identified needs.

The license holder failed to ensure P1’s support plan was implemented when staff left P1 alone while eating.

· P1 “Coordinated Service and Support Plan” shows “Staff will be with P1 when they are eating”. P1 is at risk for aspiration and choking due to a diagnosis of hemiplegia and history of TBI.

· On October 8, 2022, SP1 prepared P1’s lunch and then left the area to use the restroom in the lower level of the residence. Two staff were working at the time, however, SP2 was asleep on the couch.

· When SP1 returned to the area, SP1 found P1 choking and “appeared to be purple”. SP1 performed the Heimlich Maneuver and was able to clear the obstruction.

Statute Violated: 245D.07, Subd 1a, paragraph (a).

Repeat Violation: In a Correction Order that DHS issued on December 10, 2021, November 16, 2022, March 13, 2023, and March 14, 2023, you were previously found in violation of this same statute.

Corrective Action Required: Within 30 days of receiving this order, you must submit to your licensor a plan detailing:

· how your program will provide the level of direct service support staff supervision, assistance, and training necessary to ensure the health, safety and protection of rights for each person; and

· implement the responsibilities assigned to the license holder in each person's support plan or identified in the support plan addendum, according to the requirements of this chapter.

On an ongoing basis, you must ensure support plans are implemented as required.

You have the right to request reconsideration of this order and the cited violations. Your request must:

· Be in writing

· List each violation you are challenging and identify what is inaccurate or incomplete about the information in the order

· Supply information that is accurate or more complete

· Be made before the deadlines provided below

If you are mailing your request, it must be received by DHS within 20 calendar days from when you received this order. If you do not meet this deadline, you lose your right to request reconsideration. The timeline to appeal began when you received this order. Please send it to:
