CORRECTION ORDER

Dear Blake Elliott:

On March 14, 2023, a licensing investigation of Bridges MN, located at 1932 University Avenue West, Saint Paul, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing investigation a Correction Order is being issued.

A. Reason for Correction Order

Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder.

The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services.

1. Citation: Minnesota Statutes, section 245D.05, subdivision 1, paragraph (b).

Violation: For one of one person whose record was reviewed (P1), the license holder did not document how health needs would be met as required.

The license holder was assigned the responsibility of administering P1’s medications in P1’s coordinated service support plan addendum dated November 7, 2022. The license holder hold failed to document a notation of when some or all of P1’s medications were administered on the following dates: January 8, 2023, January 25, 2023, and January 31, 2023.

Corrective Action Ordered: Within 30 days of this order, because the license is currently revoked, operating under appeal, you must share this correction order with the person, the person’s legal representative, and the person’s case manager and inform each of them how you will maintain compliance with this licensing requirement on a continuing basis. On an ongoing basis, you must maintain compliance as required with this subdivision.

2. Citation: Minnesota Statutes, section 245D.07, subdivision 1a.

Violation: For one person whose record was reviewed (P1), the license holder did not provide services in response to P1’s identified needs.

In an interview conducted on March 13, 2023, the license holder stated they were responsible for setting up P1’s medications; however, P1’s coordinated service support plan addendum dated November 7, 2022, stated the license holder was responsible for administering P1’s medications. On December 28, 2022, a Health Dose Machine was set up in the home assist P1 to be more independent with their medications; however, the license holder was still assigned the responsibility for administering P1’s medications. The license holder failed to update P1’s support plan of how medications would be administered when the Health Dose Machine was implemented. The license holder stated that they were not administering P1’s medications in January 2023 As a result, P1 did not take all their medications as prescribed in January 2023. The license holder failed to administer P1’s medications according to P1’s coordinated service support plan.

Citation: Within 30 days of receipt of this order, because the license is currently revoked, operating under appeal, you must share this correction order with the person, the person’s legal representative, and the person’s case manager and inform each of them how you will maintain compliance with this licensing requirement on a continuing basis. You must update P1’s support plan to state how staff will administer P1’s with the Health Dose Machine, and submit to the case manager for approval. On an ongoing basis, you must maintain compliance as required with this subdivision.

3. Citation: Minnesota Statutes, section 245D.081, subdivisions 2 and 3.

Violation: The license holder failed to provide program management and oversight as required.

The license holder failed to ensure staff competency to direct staff implementing P1’s support plan. The license holder stated staff did not know how to document P1’s medications after the Health Dose Machine was implemented. Staff were not properly trained what their responsibilities were after the implementation of the Health Dose Machine.

Corrective Action Ordered: On an ongoing basis, you must provide the program management and oversight as required in this subdivision.

B. Right to Request Reconsideration

If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report. Your request for reconsideration must be sent to:

Please note that a request for reconsideration does not stay any provisions or requirements of the Correction Order. The Commissioner’s disposition of a request for reconsideration is final and not subject to appeal under Minnesota Statutes, chapter 14.
