CORRECTION ORDER
An investigation of Bridges MN Jackson was completed regarding report number 202210226 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned neglect. The dispositions of the investigation report are inconclusive. Three violations were noted.
VIOLATIONS AND CORRECTION ORDERS
The following violations of state and (or) federal laws and rules were observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.
1. Citation: Minnesota Statutes, section 245D.05, subdivision 2, paragraph (b), clause (1).
Violation: The license holder was responsible for administering a vulnerable adult’s (VA) medications and did not ensure that the VA’s medications were administered as prescribed.
Repeat Violation: In a Correction Order that DHS issued on March 10, 2020, October 7, 2020, February 5, 2021; April 2, 2021; November 9, 2021; November 22, 2022 and November 30, 2022 you were previously found in violation of this same statute.
Corrective action ordered: Because the license is currently revoked, operating under appeal, within 30 days, you must share this correction order with the person, the person’s legal representative, and the person’s case manager and inform each of how you will maintain compliance with this licensing requirement on a continuing basis. On an ongoing basis, you must provide services as required in this subdivision.
2. Citation: Minnesota Statutes, section 245D.07, subdivision 1a, paragraph (a).
Violation: The license holder did not provide services in response to the persons identified needs as specified in the support plan addendum.
The VA medication administration record (MAR) states “take 7.5mg tablet in addition to daily dose for up to 4 days as needed per Legal Guardian Instruction”. The MAR also shows that this “stress dosing” is to be complete per guardian request on an as needed basis.
On December 9, 2022, the VA’s guardian requested facility staff persons to administer the VA’s “stress dosing” of prednisone to combat the VA’s lethargy. The facility staff persons failed to follow the VA’s plans to maintain the VA’s health needs.
Repeat Violation: In an Order of License Revocation, Determinations of Maltreatment, and Failure to Report Maltreatment dated June 27, 2022; and in Correction Orders that DHS issued on July 30, 2019; March 22, 2019; May 20, 2021; October 15, 2021; December 6, 2021; February 25, 2022; June 8, 2022; August 19, 2022; September 29, 2022; November 4, 2022; November 10, 2022 and November 22, 2022 you were previously found in violation of this same statute.
Corrective action ordered: Because the license is currently revoked, operating under appeal, within 30 days, you must share this correction order with the person, the person’s legal representative, and the person’s case manager and inform each of how you will maintain compliance with this licensing requirement on a continuing basis. On an ongoing basis, you must provide services as required in this subdivision.
3. Citation: Minnesota Statutes, section 245D.081, subdivision 2.
Violation: The license holder did not ensure coordination and evaluation of individual service delivery as required.
On December 9, 2022 the VA’s guardian requested facility staff persons to administer the VA’s “stress dosing” of prednisone. Staff was not aware this medication was available or how to provide the medication as indicated on the MAR.
Multiple staff claimed they were unable to provide the VA with their medication as they believed they did not have authorization from the prescriber to do so. According to the VA’s MAR, this medication was prescribed September 16, 2022.
Repeat Violation: In an Order of License Revocation, Determinations of Maltreatment, and Failure to Report Maltreatment dated June 27, 2022; and in Correction Orders that DHS issued on June 14, 2019; May 20, 2021; June 3, 2022; October 14, 2022; November 4, 2022; November 10, 2022 you were previously found in violation of this same statute.
Corrective action ordered: Because the license is currently revoked, operating under appeal, within 30 days, you must share this correction order with the person, the person’s legal representative, and the person’s case manager and inform each of how you will maintain compliance with this licensing requirement on a continuing basis. On an ongoing basis, you must provide services as required in this subdivision.
If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
