Dear Holly Christine Petrich:
The Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration of the sole citation from the Correction Order issued to you by the Department of Human Services on June 8, 2022.
SUMMARY OF CITATION AND RECONSIDERATION DETERMINATION:
Citation 1. The program did not contact DHS or resubmit a background study online for 4 of 4 (SP2, SP4, SP8 and SP18) individuals (director, staff persons, substitutes, or unsupervised volunteers) when the background study subject's name did not appear in the list of active or recent studies initiated by the program.
Your Response. You identified challenges in completing the background study submission requirements, including limited locations and hours of operation to obtain fingerprints, issues in receiving links to sign the new disclosure forms, and an issue with SP2 having to repeat the fingerprint process because the initial fingerprints taken were not sufficient.
Applicable Law. If the license holder initiates background study under the commissioner's online system, but the background study subject's name does not appear in the list of active or recent studies initiated by that license holder, the license holder must either contact the human services licensing division or resubmit the background study information online for that individual. Minnesota Statutes, section 245C.20, subdivision 1. Reconsideration Determination. You did not deny the violation cited, but provided several reasons explaining why you believe you were not able to comply with the requirement. While the Commissioner appreciates the efforts you took to complete some of these submission requirements, as well as the challenges that existed at the time, it remains the license holder’s responsibility to comply with the requirements of 245C. You also stated that had you been granted a 45 day grace period to complete these requirement, you would have done so you – however, the staff persons with incomplete background study submissions were working with children for time periods ranging from two to six months before studies were resubmitted with all of the submission requirements completed. The record supports the citation and it is affirmed.
Disposition: The Commissioner has reviewed the relevant laws and all of the information you submitted in response to the Correction Order. Citation 1 is supported by the record and affirmed. This is a final agency decision.
