CORRECTION ORDER Dear Ms. Vimont, On October 24 and 25, 2022, a licensing review of Nexus Kindred Family Healing, located at is 5985 Rice Creek Parkway, Suite 202, Shoreview, MN 55126, was conducted to determine compliance with state and federal laws and rules governing the provision of child-placing agencies under Minnesota Rules, parts 9545.0755 through 9545.0845 (Rule 4). As a result of this licensing review, a Correction Order is being issued. Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that an applicant or license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the applicant or license holder. The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services. 1. Citation: Minnesota Statute, part 245A.04 Subdivision 10. Violation: The agency’s bond must be made in favor of the agency which has agreed to receive the records. The bond was in favor of the Minnesota Department of Human Services instead of Family Alternatives. 2. Citation: Minnesota Rules, part 9545.0785, subpart 4.
Violation: The agency’s conflict of interest policy did not have a statement that the board of directors could not be a foster care or adoption applicant. 3. Citation: Minnesota Rules, part 9545.0805, subpart 3. Violations: Five employees did not have 12 hours of annual training, as required. SP1 lacked 12 hours of the required 12 hours of annual training in 2020. SP2 lacked 6 of the required 12 hours of annual training in 2021. In 2020, SP3 and SP4 lacked 3.85 of the 12 hours of annual training. SP5 lacked 1.1 hours of the required 12 hours of annual training in 2020. In addition, the agency’s annual training policy did not reflect the emphasis in Minnesota Statutes, section 260C.215, subd. 6, on cultural diversity, as required. 4. Citation: Minnesota Rules, part 9545.0835, subpart 2. Violation: Adoption file 1 did not have a disclosure form on file, and/or was not signed by the applicant, as required. Corrective Action Ordered for Citations 1-4: Within 30 days from receipt of this order, you must submit evidence of corrective action taken to ensure ongoing compliance. If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.
