CORRECTION ORDER

Dear Ms. Bergstedt:

On January 31, 2022, a Department of Human Services (DHS) licensor determined that American Indian Family and Children Services was in violation of one of the state and federal laws and rules governing the provision of child-placing agencies under Minnesota Statutes, section 245A. As a result of this determination, a Correction Order is being issued.

LICENSING VIOLATION

DHS determined that your program failed to follow licensing rules and statutes, as described below.

Noncompliance with Licensing Rules and Statutes

· On September 21, 2021, American Indian Family and Children Services (AIFACS) was notified by DHS that a license holder (LH1) was disqualified. The child foster care home was also notified of the disqualification, and a request for reconsideration was not submitted. Between November 2022 and January 2023, DHS requested a licensing action recommendation from AIFACS.

American Indian Family and Children Services failed to submit a licensing action recommendation for LH1, as required.

Statute Violated: Minnesota Statutes, section 245A.16, subdivisions 1 and 2.

Corrective action required

You must correct the violation cited above. Submit documentation to your licensor within 30 days from when you received this order explaining how you have corrected the violations.

YOUR RIGHT TO REQUEST RECONSIDERATION

You have the right to request reconsideration of this order and the cited violations. Your request must:

· Be in writing

· List each violation you are challenging and identify what is inaccurate or incomplete about the information in the order

· Supply information that is accurate or more complete

· Be made before the deadlines provided below

If you are mailing your request, it must be received by DHS within 20 calendar days from when you received this order. If you do not meet this deadline, you lose your right to request reconsideration. The timeline to appeal began when you received this order. Please send it to:

· This child-placing agencies must maintain compliance with the licensing statutes and rules, specifically Minnesota Rules, parts 9543.

· The timeline to request reconsideration of the order is provided in Minnesota Statutes, section 245A.06, subdivision 2.
