May 17, 2023 Lisa Thelen REM North Star, Inc. 6600 France Avenue South Suite 350 Edina, MN 55435 RE: Report No. 202300765 REM North Star, Inc. - Branch Court License No. 1071579/1071573 Dear Lisa Thelen: CORRECTION ORDER An investigation of REM North Star, Inc. - Branch Court was completed regarding report number 20230765 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned neglect and abuse. The disposition of the investigation report is substantiated. Two violations were noted. VIOLATIONS AND CORRECTION ORDERS The following violations of state and (or) federal laws and rules were observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07. 1. Citation: Minnesota Statutes, section 245D.04, subdivisions 1 and 3. Violation: The license holder did not ensure the exercise and protection of a resident’s protection-related rights. It was determined through interviews with staff persons and a resident that: · On January 12, 2023, a staff person (SP1) left a person served (P1) lying on the floor for several hours and threw a plastic ball at P1 as s/he was lying on the floor; · On January 12, 2023, SP1 dumped the contents of a garbage can on a person served (P2) head, placed the garbage can on P2’s head, and placed the plastic garbage bag on P2’s head and pulled it tight against P2’s face. On unknown dates, SP1 kicked P2’s wheelchair, and frequently toldP2 to “shut the fuck up;” and · On unknown dates, SP1 gave on a person served (P3) cold showers and sprayed cold water, served P3 hot food causing burns to P3’s mouth, kicked P3’s wheelchair, swore at P3, and locked the brakes on P3’s wheelchair. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision. 2. Citation: Minnesota Statutes, section 245D.07, subdivision 1, paragraph (a). Violation: The license holder did not ensure that services were provided in response to the individual’s identified needs, interests, preferences, and desired outcomes as identified in the individual’s plans. It was determined through interviews with staff persons and a resident that: · P1’s support plan stated that if P1 fell while unobserved, the staff persons were to contact 9-1-1 to ensure that P1 did not sustain any head injury. On January 12, 2023, P1 fell in his/her bedroom and SP1 did not assist P1 or contact 9-1-1. · P2 frequently moaned or flinched when approached by SP1 who kicked P2’s wheelchair, and frequently told P2 to “shut the fuck up.” · The staff persons were trained to assist the residents with their personal cares and hygiene. On numerous unknown dates, SP1 gave cold showers to P3, which caused P3 to scream because s/he did not like to be showered with cold water. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision. If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
