CORRECTION ORDER
Dear Anna Manque: On June 6, 2023, a Department of Human Services (DHS) licensor conducted a licensing review at your facility located at 3505 8th street, Moorhead, Minnesota. As a result of this visit, DHS determined that you are in violation of two of the Home and Community Based Services, rules and statutes. As a result, DHS is issuing this order which requires you to take the correction action as described under each violation. Details of our findings are provided below. Our next steps and your options are also detailed. LICENSING VIOLATIONS
DHS determined that your program failed to follow licensing rules and statutes, as described below. Service Recipient
1. Violation: For one of one person whose record was reviewed (P1), the license holder did not complete an individual abuse prevention plan (IAPP) as required.
In a support plan dated November 10, 2022, it was documented that P1 has a history of suicidal ideations and self-harm. In an IAPP dated November 10, 2022, the license holder failed to include an individualized assessment and the measures staff would take to minimize the risk of abuse for P1. P1’s IAPP documented they were not susceptible to any forms of abuse. Statute Violated: 245A.65, subdivision 2, paragraph (b).
Corrective Action Required: Within 30 days of receiving this order, you must ensure the above information is assessed in P1’s IAPP. On an ongoing basis, you must ensure you complete abuse prevention plans as required. Staff
2. Violation: For one of three staff persons whose records were reviewed (SP1), the license holder did not provide orientation as required.
For SP1 with a hire date of November 26, 2022, the license holder failed to provide the following: · Orientation to program requirements that included:
o the principals of person-centered planning; and
o strategies to minimize the risk of sexual violence.
· Orientation to individual service recipient needs training that included:
o instruction on the person's support plan or support plan addendum as it relates to the responsibilities assigned to the license holder, and when applicable, the person's individual abuse prevention plan, to achieve and demonstrate an understanding of the person as a unique individual, and how to implement those plans.
Statutes Violated: 245D.09, subdivisions 4 and 4a. Corrective Action Required: Within 30 days of receiving this order, you must: o ensure SP1 is provided the above-mentioned orientation training; and
o audit all staff records to ensure orientation to program requirements and individual service recipient needs have been completed as required.
On an ongoing basis, you must ensure you complete abuse prevention plans as required. YOUR RIGHT TO REQUEST RECONSIDERATION
