On December 5, 2022, the Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration of the citation in the Correction Order (Attachment A) issued to you by the Department of Human Services on November 16, 2022. You requested reconsideration of citation 1.
SUMMARY OF CITATIONS AND RECONSIDERATION DETERMINATION: Citation 1: Violation: A child was fed the wrong bottle. The license holder failed to follow written dietary instructions from an infant’s parent and failed to ensure that appropriate procedures and practices were used to handle breast milk. On October 14, 2022, an infant was given breast milk from another child’s bottle. (Infant classroom)
Request for Reconsideration. You indicated the program followed all statutes, regulations and protocols and that they do not need to report a mistake of milk. You also indicated no harm was done and that the program has all appropriate policies in place including identifying breast milk and formula and double checking that bottles are matched prior to feeding. You indicated the incident was due to human error rather than a lack of training.
Applicable Law. Under Minnesota Rules, part 9503.0145, subpart 7, the diet of an infant must be determined by the infant’s parent. The license holder must ensure that sanitary procedures and practices are used to prepare, handle and store formula, milk, breast milk, solid foods and supplements. Procedures must be reviewed and certified by a health consultant. A center serving infants must: A. obtain written dietary instructions from the parent of a child; B. have the infant’s feeding schedule available in the food preparation are; C. offer the child formula or milk and nutritionally adequate solid foods in prescribed quantities at specified time intervals; and D. label each child’s water bottle.
Reconsideration Determination. The rule requires that the diet of an infant be determined by the infant’s parent and that a center must offer the child formula or milk in prescribed quantities. Although the child did not suffer harm as a result of the incident, the child was fed the wrong bottle containing breast milk. As such, because the program did not follow written dietary instructions from an infant’s parent, there is sufficient evidence to support the citation, and it is affirmed.
Disposition: The Commissioner has reviewed the request for reconsideration and all the information submitted in response to the correction order. The Commissioner finds there is sufficient evidence to support citation #1, and it is affirmed. This is a final agency decision.
