August 9, 2023 Stephanie Kalbach, Authorized Agent REM River Bluffs, Inc. 6600 France Avenue South, Suite 350 Edina, MN 55435 RE: Report No. 202303899 REM River Bluffs, Inc. - Cedarwood License No. 1071928/1071879 Dear Stephanie Kalbach: CORRECTION ORDER An investigation of REM River Bluffs, Inc. - Cedarwood was completed regarding report number 202203899, which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned neglect and emotional abuse. The disposition of the investigation report is inconclusive. Two violations were noted. Two recommendations were made. VIOLATIONS AND CORRECTION ORDER The following violation of state and (or) federal laws and rules was observed. Corrective action for the violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07. 1. Citation: Minnesota Statutes section 245D.09, subdivision 5, paragraph (a), clause (2). Violation: For two of five staff whose records were reviewed (PR1 and PR2), the license holder did not maintain personnel records as required. The license holder failed to maintain documentation that PR1 and PR2 received training on each client’s (C1-C4) support plan and support plan addendum. Corrective Action Ordered: Correct immediately and maintain compliance with this licensing requirement on a continuing basis throughout the program. 2. Citation: Minnesota Statutes section 245D.05, subdivision 1, paragraph (b), clause (2). Violation: For one client whose record was reviewed (C3), there was no tracking documentation to monitor C3’s health condition according to written instructions from a licensed health professional. C3’s medical records stated that s/he was on a fluid restriction and that the facility was supposed to track C3’s fluid intake throughout each day. This was not completed. Corrective Action Ordered: Correct immediately and maintain compliance with this licensing requirement on a continuing basis throughout the program. RECOMMENDATION ORDER The following recommendation is not a requirement of Minnesota Rules or laws governing your services or facility. This recommendation is provided to call your attention to areas where your facility or service is in minimum compliance with the requirements of rules or laws, but it would be advisable to strengthen your efforts in these areas. Failure to follow this recommendation will not result in a fine or action against your license at this time. However, should failure to follow recommendations result in a violation of rules or laws at a future date, you will be cited for noncompliance and may be subject to fines or action against your license. The documentation reviewed for the maltreatment investigation did not accurately record each client’s needs and supports in the following ways: · Consistent information was provided that C1 was unable to navigate stairs independently and needed staff support to do so. This level of need or support was not recorded in C1’s support plan and/or support plan addendum. It is recommended that the facility ensure C1’s support plan and/or support plan addendum accurately record his/her needs and supports. · C3’s medical records stated that s/he was on a fluid restriction to maintain sodium levels. However, C3’s support plan and/or support plan addendum stated that s/he “doesn’t have any special dietary needs” and there was no other mention of the need for a fluid restriction. It is recommended that the facility ensure C3’s support plan and/or support plan addendum accurately record his/her needs and supports. If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
