CORRECTION ORDER
Dear Blake Elliott: On August 25, 2023, a Department of Human Services (DHS) licensor conducted a licensing investigation, as a result of this investigation, DHS determined that you are in violation of one of the 245D Home and Community Based services rules and statutes. As a result, DHS is issuing this order which requires you to take the correction action as described below. Details of our findings are provided below. Our next steps and your options are also detailed. LICENSING VIOLATIONS
DHS determined that your program failed to follow licensing rules and statutes, as described below. Service Recipient
Violation: For one of one person whose record was reviewed (P1), the license holder did not respond to incidents as required. An emergency use of manual restraint (EUMR) was used on P1 June 25, 2023. The license holder failed to report the EUMR to P1’s legal representative and case manager within 24 hours. The license holder reported the use of emergency manual restraint on July 6, 2023. Statute Violated: 245D.06, subdivision 1, paragraph (h).
Corrective action required
Because the license is currently revoked, operating under appeal, you must:
· share this correction order with P1, P1’s legal representative (if applicable), and case manager;
· inform each of the above-mentioned people, how you will maintain compliance with this licensing requirement on a continuing basis;
· submit to the licensor evidence showing that the above-mentioned requirements have been completed; and
· maintain evidence in P1’s record.
On an ongoing basis, you must maintain compliance as required.

· List each violation you are challenging and identify what is inaccurate or incomplete about the information in the order
· Supply information that is accurate or more complete

If you do not meet this deadline, you lose your right to request reconsideration. The timeline to appeal began when you received this order.
