CORRECTION ORDER

An investigation of Divine House Inc. was completed regarding report number 202301800 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned neglect, emotional abuse, and financial exploitation. The disposition of the investigation report is inconclusive and false. Four violations were noted.

A. Reason for Correction Order

The following violations of state and (or) federal laws and rules was observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.

1.   Citation: Minnesota Statutes, section 254D.05, subdivision 1a, paragraph (a).

  Violation: For the purposes of this subdivision, “medication setup” means the arranging of   medications according to instructions from the pharmacy, the prescriber, or licensed nurse, for   later administration when the license holder is assigned responsibility in the support plan or the   support plan addendum. A prescription label or the prescriber’s written or electronically recorded   order for the prescription is sufficient to constitute written instructions from the prescriber.

  

  In February 2023, for one person whose record was reviewed (P1), a medication was not     listed on P1’s Medication Administration Record. A staff person continued to set up the       medication for other staff persons to administer to P1.

  Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in   this item.

2.   Citation: Minnesota Statutes, section 245D.05, subdivision 2, paragraph (a), clauses (1-4).

  Violation: For the purpose of this subdivision, “medication administration” means:

§ Checking the person’s medication record;

§ Preparing the medication as necessary;

§ Administering the medication or treatment to the person;

§ Documenting the administration of the medication or treatment of the reason for not administering the medication or treatment.

  

  In February 2023 facility staff persons continued to administer medication to P1 that was     not listed on P1’s Medication Administration Record, and nothing was documented.

  Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in   this item.

3. Citation: Minnesota Statutes, section 245D.09, subdivision 1

Violation: The license holder must be able to implement the responsibilities assigned to the license holder in each person’s support plan or identified in the support plan addendum, according to the requirements of this chapter.

On March 6, 2023, a staff person failed to provide close observation of P1 while shopping in the community, as stated in P1’s Coordinated Service and Support Plan.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this item.

4. Citation: Minnesota Statutes, section 245A.04, subdivision 14, paragraph (b), item 3

Violation: The license holder shall monitor implementation of policies and procedures by program staff.

In February 2023, a staff person borrowed P1 money which was against the facility’s Funds and Property Procedures of the individuals We Serve policy.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this item.

B.   Right to Request Reconsideration

  If you believe any of the citations are in error, you may ask the Commissioner of Human Services   to reconsider the parts of the correction order that you believe to be in error. If you choose to   exercise this right, your request for reconsideration must be in writing and received by the   Commissioner within 20 calendar days after receipt of this letter.   You must include any and all information, documentation, or other evidence you have to support   your request for reconsideration. Please note that a request for reconsideration does not stay   any provisions of the correction order.
