You did not request reconsideration of any other citation, therefore, those citations are final and not subject to review. SUMMARY OF CITATIONS AND RECONSIDERATION DETERMINATION: Citation 3. Equipment and furniture were not in good repair. Toddler Room: Toddler classroom · The faucet to the dramatic play kitchen sink was missing. · The bowl to the dramatic play kitchen sink missing. Your Response. In your request for reconsideration, you stated that the bowl was not missing, but that children had removed it to use it for other play. You stated that the bowl is a removable piece of the kitchen and children often to remove it to use it for other pretend play. You did dispute violation as to the missing faucet. Applicable Law. Equipment and furniture must be durable, in good repair, structurally sound and stable following assembly and installation. Minnesota Rules, part 9503.0140, subpart 19. Reconsideration Determination. You did not dispute that the faucet for the play kitchen sink was missing, and the citation is affirmed as to that portion of the citation. The bowl of the kitchen sink was not in place when the licensor observed the play kitchen. However, the bowl of the play kitchen was designed so that it could be removed by children and played with in multiple ways. During the exit interview, the program director did state that children sometimes remove the bowl and play with it in other pretend play. The record indicates that the bowl was not missing, that it was in good repair, but was removed by children for use while playing. The record supports part of the citation and it is affirmed in part (faucet), and rescinded in part (bowl). Disposition: The Commissioner has reviewed the relevant laws and all of the information you submitted in response to the Correction Order. Citation 3 is affirmed in part (faucet), and rescinded in part (bowl). This is a final agency decision. The Commissioner appreciates your response and encourages you to continue to work cooperatively with your licensor to ensure the safety and well-being of the children you serve.
