CORRECTION ORDER
An investigation of Olu’s Home, Inc.-East River was completed regarding report number 202206475, which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned neglect, emotional abuse, and aversive or deprivation procedures. The disposition of the investigation report is substantiated. Three violations were noted.
VIOLATIONS AND CORRECTION ORDERS
The following violations of state and (or) federal laws and rules was observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.
1. Citation: Minnesota Statutes section 245D.09, subdivision 5, paragraph (a), clause (2).
Violation: The license holder did not maintain personnel records in a manner that documented each employee’s qualifications, orientation, and training, including the date the training was completed, the number of hours per subject area, and the name of the trainer or instructor.
The facility did not provide documentation that staff persons (S1, S2, and S3) received training on the housemates’ support plans and support plan addendums.
Corrective Action Ordered: Correct immediately and maintain compliance with this licensing requirement on a continuing basis throughout the program.
2. Citation: Minnesota Statutes section 245D.04, subdivision 2, clause (2); and subdivision 3, paragraph (a), clauses (4) and (6).
Violation: The license holder did not consistently uphold a person’s service-related and protection-related rights.
Consistent information was provided that, more than once, S1 forced a person (P) into the basement and locked the door preventing the P from leaving the basement. The P would “bang” on the door and yell, and at times was not let out for up to eight hours.
Corrective Action Ordered: Correct immediately and maintain compliance with this licensing requirement on a continuing basis throughout the program.
3. Citation: Minnesota Statutes section 245D.05, subdivision 1, paragraph (a).
Violation: The license holder did not provide services in response to the P’s identified needs.
Consistent information was provided that there was a two-month delay in follow-up on the P’s needed medical appointment regarding the removal of staples. The P relied on the facility to ensure his/her medical needs were met.
Corrective Action Ordered: Correct immediately and maintain compliance with this licensing requirement on a continuing basis throughout the program.
If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
