Dear Angela Damaris Carlson:

On July 3, 2023, the Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration of citation 2 in the Correction Order (Attachment A) issued to you by the Department of Human Services on June 15, 2023. You did not request reconsideration of the remaining citations. As a result, those citations are affirmed and are now final.

SUMMARY OF CITATION AND RECONSIDERATION DETERMINATION:

Citation 2: Violation: Required in-service training had not been completed for two staff persons for the previous calendar year. Specifically, in-service training did not include the required number of in-service training hours for the previous calendar year.

Request for Reconsideration. You indicate in your reconsideration request that staff persons received the required trainings. You indicate that the staff persons received required orientation training and that although those trainings were not counted toward the number of in-service hours, some trainings were revisited and counted for additional training hours.

Applicable Law. Under Minnesota Statutes, section 245A.40, subdivision 7, a license holder must ensure that the center director, staff person, substitutes and unsupervised volunteers complete in-service training each calendar year in the areas specified in the statute and for the number of hours specified in the statute.

Reconsideration Determination. Records showed that one staff person (SP2) was hired in 2022 and required 12 hours of in-service training for 2022. Although the program documented that SP2 completed 12.5 hours of in-service training in 2022, six of the training hours were identical to trainings completed at an earlier date in 2022. The other staff person (SP4) was hired in 2022 and required ten hours of in-service training in 2022. Although the program documented that SP4 completed ten hours of in-service training in 2022, four and a half hours of the training hours were identical to trainings completed during orientation on an earlier date in 2022.

A training cannot be credited twice in the same calendar year. Also, orientation hours do not county toward in-service hours in the first year of employment. You acknowledge in your reconsideration request that some previously taken trainings were “revisited” later in the year and counted for additional training hours. As a result, there is sufficient evidence to support the citation, and it is affirmed.

Disposition: The Commissioner has reviewed the request for reconsideration and all the information submitted in response to the correction order. The Commissioner finds there is sufficient evidence to support the citation and it is affirmed. This is a final agency decision.
