Terms of Settlement Agreement:

1. DHS agrees to place License Holder’s family child care license on conditional status for a period of two years. The terms of this conditional license supersede the terms of the February 8, 2024 Order of Conditional License. The new conditions are:

i. License Holder, at her own expense, will obtain a family child care coach or mentor that has been pre-approved by Isanti County within thirty (30) days of execution of this settlement agreement. She must actively work with her coach or mentor on keeping her program clean, safe, organized and free of health and safety hazards, as well as keeping her program paperwork organized and submitted in a timely manner. License Holders will provide Isanti County with a signed release when she begins her mentorship program so that Isanti County may communicate with their mentor.

ii. Within 30 calendar days of execution of this settlement, License Holder must complete four hours of pre-approved training on the subject of professionalism, either in-person or online, and provide documentation of completion to Isanti County. This provision is in addition to the annual training requirements as listed in Minnesota Statutes, section 245A.50. Hours spent with the mentor in paragraph 3(i) will count toward fulfillment of this requirement.

iii. Within 30 calendar days of execution of this settlement, License Holder must complete two hours of pre-approved training on the subject of infant safe sleep, either in-person or online, and provide documentation of completion to Isanti County. This provision is in addition to the annual training requirements as listed in Minnesota Statutes, section 245A.50. Hours spent with the mentor in paragraph 3(i) will count toward fulfillment of this requirement.

iv. License Holder must comply with all applicable Minnesota Statutes and Rules, including Minnesota Statutes, chapters 245A and 245C and Minnesota Rules, parts 9502.0300 through 9502.0445.

v. No other variances as to age or capacity will be granted during the period of conditional license, except if License Holder has a child, then a variance may be granted to accommodate License Holder’s own child.
