May 8, 2024 Renae Sternke, Authorized Agent 911 18th Street North St. Cloud, MN 56303 RE: Report No. 202308836 Catholic Charities Bethany Home/Catholic Charities in Home Program License No. 1070421/1070417 Dear Renae Sternke: CORRECTION ORDER An investigation of Catholic Charities Bethany Home/Catholic Charities In Home Program was completed regarding report number 202308836 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned abuse. The disposition of the investigation report is inconclusive. One violation was noted. VIOLATIONS AND CORRECTION ORDERS The following violation of state and (or) federal laws and rules was observed. Corrective action for the violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violation within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07. Citation: Minnesota Statutes, section 245D.06, subdivision 2, clause 1, item 3 states that the license holder must ensure doors are locked from the inside to prevent a person from exiting only when necessary to protect the safety of a person receiving services and not as a substitute for staff supervision or interactions with the person. If doors are locked from the inside, the license holder must document an assessment of the physical plant, the environment and the population served, identifying the risk factors which require the use of locked doors, and a statement of specific measures to be taken to minimize the safety risk to persons receiving services at the serviced site. Violation: During a maltreatment investigation, it was found that staff persons locked an individual in his/her bedroom because of safety concerns, but the license holder did not document risk factors which required the use of locked doors and also did not provide a statement of specific measures taken to minimize the safety risks to the individual. Corrective Action Ordered: Correct immediately and maintain compliance with this licensing requirement on a continuing basis. If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
