RE: Report No. 202209242 AbleLight License No. 1096896/1070397
Dear Ms. Schmidt:
The Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration of the citation issued in the Correction Order (Attachment A) issued to you by the Department of Human Services on February 3, 2023.
Reconsideration Determination
Citation 1. This citation was issued because the license holder failed to develop an individual abuse prevention plan as part of a person’s initial individual program plan or service plan.
On October 1, 2022, a person (P) moved into the facility, but an individual abuse prevention plan was not developed for the P until November 10, 2022.
Applicable Law. License holders are required to include a statement of measures specific to the individual VA that the program will take to minimize the risk of abuse. Minnesota Statutes section 245A.65, subdivision 2, paragraph (b).
Your Response. In your reconsideration request, you state that the individual had an IAPP dated 9/20/2022. This document is included, along with a screen shot of the area documents folder that contained her admission paperwork, showing the date/time stamp of when the document was created. In addition is a report from Therap, our electronic record system, showing the communication sent out to staff on 9/21/2022 and the records of staff who acknowledged this communication.
Reconsideration Determination. When DHS made its initial request for documents including the VA’s IAPP, DHS was given the IAPP dated November 10, 2022. DHS followed up and requested a copy of plans that were in effect at the time of the incident from October 28, 2022 to November 3, 2022. The program replied that the VA moved in on October 1, 2022 and attached a copy of the interim care plan that was in place at that time. The program provided no documentation of any plan in effect covering October 28, 2022 to November 3, 2022. The record supports this citation and it is affirmed.
Disposition: The Commissioner has reviewed the relevant law and all the information you submitted in response to the correction order. The evidence presented supports the citation, and it is affirmed. This is a final agency decision.
Sincerely
Eric G. Olsen, Legal Office Division of Licensing Office of Inspector General
