Terms of Settlement Agreement:

DHS agrees to stay the $200 fine for a period of two years from the date of execution.

The License Holder’s family child care license shall remain on conditional status for one year from the effective date of this Settlement Agreement.  While under the conditional license, the License Holder shall comply with the following terms:

1. License Holder must follow and comply with all applicable Minnesota Rules and Laws.

2. No variances to age distribution or capacity will be granted during the conditional period.

3. License Holder will drop to a Class A license for the conditional license period.

4. License Holder must submit and comply with a detailed plan regarding supervision. The plan must outline where License Holder will be during nap times. The plan must outline where each child will sleep to ensure that each sleeping arrangement is appropriate and in accordance with the manufacture’s guidelines of the equipment used. The plan must be submitted to Clay County within 30 days of execution of this settlement. This plan must be approved by Clay County.

5. License Holder must complete at least six hours of additional training within 60 days of execution of this settlement. The training is in addition to the annual training requirements as listed in Minnesota Statutes, section 245A.50. The training must include training on supervision and child safety. Prior to attending training, License Holder must obtain approval from Clay County that the training is appropriate. License Holder must submit documentation of her training attendance to Clay County.

6. License Holder must complete at least two hours of additional training within 60 days of execution of this settlement. The training is in addition to the annual training requirements as listed in Minnesota Statutes, section 245A.50. The training must include training on child development. Prior to attending training, License Holder must obtain approval from Clay County that the training is appropriate. License Holder must submit documentation of her training attendance to Clay County.

7. License Holder must either provide a copy of the Order to Pay a Fine and Order of Conditional License to parents of children in care or document that all parents have been given an opportunity to review the Order. License Holder must obtain parent signatures of each currently enrolled child, indicating they have either received a copy of the Order or had an opportunity to review the Order. License Holder must provide this documentation to Clay County within 30 days of execution of this settlement. For new families, License Holder must submit documentation of compliance with this term to Clay County within 5 days of any child’s admission to her child care program.
