Dear Zamzam Mumin:

On April 18, 2024, the Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration of citation 2 in the Correction Order (Attachment A) issued to you by the Department of Human Services on April 9, 2024. You did not challenge the remaining citations, and those citations are therefore final and not within the scope of this review.

SUMMARY OF CITATION AND RECONSIDERATION DETERMINATION:

Citation 2: Violation: Food allergy information was not readily available to staff where food served.

Request for Reconsideration. You indicate in your reconsideration request that allergy information is in each classroom, in the main office, in children’s files, and in the kitchen where meals are prepared/portioned. You also indicate staff are trained on allergies annually and were able to readily answer questions regarding allergies. You acknowledge that allergy information was removed from the cafeteria/gym, which “has a lot of foot traffic,” and you indicate it was removed because you understood that private medical information should not be accessible to all people.

Applicable Law. Under Minnesota Statutes, section 245A.41, subdivision 1, paragraph (d) a child’s allergy information must be available at all times including on site, when on field trips, or during transportation. A child’s food allergy information must be readily available to a staff person in the area where food is prepared and served to the child.

Reconsideration Determination. The applicable statute requires that allergy information be readily available to a staff person in the area where food is served to the child. During the licensing visit, staff persons indicated allergy information was not posted or stored in the area where children eat. As a result, there is sufficient evidence to support the citation, and it is affirmed.

Disposition: The Commissioner has reviewed the request for reconsideration and all the information submitted in response to the correction order. The Commissioner finds there is sufficient evidence to support the citation and it is affirmed. This is a final agency decision.
