Dear Jayme Wuchko:

On September 5, 2024, the Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration of citation 2 in the Correction Order (Attachment A) issued to you by the Department of Human Services on August 30, 2024. Because you did not challenge the remaining citations, those citations are conclusive and not within the scope of this review.

SUMMARY OF CITATION AND RECONSIDERATION DETERMINATION:

Citation 2: Violation: The program did not notify the commissioner of a name change when an individual (director, staff persons, substitutes, or unsupervised volunteers) had a legal name change. Specifically, on July 3, 2024, a review of six staff persons personnel records showed that one staff person (SP6) did not have an updated background study after a legal name change.

Request for Reconsideration. You indicate in your reconsideration request that no staff persons had a recent legal name change. You indicate that SP6’s maiden name was changed in 2016 due to marriage and has remained the same during that time. You indicate the program had brought the issue to the licensor’s attention on two occasions and was advised the name would be updated. You submitted a copy of the staff person’s driver’s license showing that individual’s legal name as of February 5, 2020. You indicate an application has now been submitted to have the name updated per the correction order.

Applicable Law. Minnesota Statutes, section 245C.04, subdivision 7, requires a license holder or entity who initialed a background study to initiate a new study or notify the commissioner when an individual who is affiliated with the license holder or entity undergoes a legal name change.

Reconsideration Determination. Information provided by the licensor indicated they were not able to change submissions in the background study system, and the license holder is responsible for initiating a new background study or providing notice to the commissioner to ensure the name is correct. You acknowledged in your reconsideration request that you submitted an application after the licensing visit to reflect the correct name. There is therefore sufficient evidence to support the citation and it is affirmed.

Disposition: The Commissioner has reviewed the request for reconsideration and all the information submitted in response to the correction order. The Commissioner finds there is sufficient evidence to support the citation, and it is affirmed.

Previously Ordered Corrective Action: In the Correction Order issued on August 30, 2024, you were ordered to correct the violations cited and submit documentation of such action to your licensor. A request for reconsideration does not stay any provisions or requirements of the correction order. Minnesota Statutes, 245A.06, subdivision 2(a). If you have not done so already, please immediately comply with the previously ordered corrective actions for all uncontested and affirmed violations.
