Dear Melinda Arora:

On September 16, 2024, the Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration of citation 4 in the Correction Order (Attachment A) issued to you by the Department of Human Services on August 28, 2024. Because you did not challenge the remaining citations, those citations are final and not within the scope of this review.

SUMMARY OF CITATION AND RECONSIDERATION DETERMINATION:

Citation 4: Violation: The program did not comply with the requirements for naps and rest. Specifically, cribs, cots, mats and beds were not placed with clear aisles and unimpeded access for both adults and children on at least one side.

Request for Reconsideration. You indicate you requested reconsideration because the cribs have “four sides” and one “side” provided unimpeded access. As a result, you believe you were in compliance with the rule. You also submitted photographs.

Applicable Law. Under Minnesota Rules, part 9503.0050, subpart 4, cribs, cots, beds, and mats must be placed so there are clear aisles and unimpeded access for both adults and children on at least one side of each piece of napping and resting equipment.

According to www.dictionary.com, “side” is defined as one of the lateral surfaces of an object, as opposed to the front, back, top and bottom. According to www.merriam-webster.com, “side” is defined as one of the longer bounding surfaces or lines of an object especially contrasted with the ends.

Reconsideration Determination. The applicable rule requires that cribs be placed so there are clear aisles and unimpeded access for both adults and children on at least one side. Although the photograph shows unimpeded access to the front/end of the cribs, there was no clear aisle and unimpeded access on at least one side as required by the rule. There is sufficient evidence to support the citation and it is affirmed.

Disposition: The Commissioner has reviewed the request for reconsideration and all the information submitted in response to the correction order. The Commissioner finds there is sufficient evidence to support the citation, and it is affirmed.

Previously Ordered Corrective Action: In the Correction Order issued on August 28, 2024, you were ordered to correct the violations cited and submit documentation of such action to your licensor. A request for reconsideration does not stay any provisions or requirements of the correction order. Minnesota Statutes, 245A.06, subdivision 2(a). If you have not done so already, please immediately comply with the previously ordered corrective actions for all uncontested and affirmed violations.
