CORRECTION ORDER
An investigation of Cardinal of Minnesota was completed regarding report number 202405832, which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned neglect. The disposition of the investigation report is inconclusive. Three violations were noted.
VIOLATIONS AND CORRECTION ORDERS
The following violations of state and (or) federal laws and rules were observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.
1. Citation: Minnesota Statutes section 245C.07, paragraph (f)
Violation: The license holder did not use NetStudy 2.0 to document their active roster.
On September 8, 2006, the license holder submitted a background study for a staff person (S1) under the original NetStudy, which was cleared on September 12, 2006. However, when required the license holder did not transfer or affiliate S1 under the entities in NetStudy 2.0. Corrective Action Ordered: Correct immediately and maintain compliance with this licensing requirement on a continuing basis throughout the program.
2. Citation: Minnesota Statutes section 245C.04, subdivision 7
Violation: The license holder did not initiate a new background study for an individual who underwent a legal name change or notify the commissioner of the name change through a notice to the commissioner.
On September 12, 2006, the license holder received a background study clearance for S1. At some point between September 12, 2006, and July 9, 2024, S1 underwent a legal name change and the license holder did not submit a new background study and/or notify the commissioner.
Corrective Action Ordered: Correct immediately and maintain compliance with this licensing requirement on a continuing basis throughout the program.
3. Citation: Minnesota Statutes section 245D.04, subdivision 3, paragraph (a), clause (6)
Violation: The license holder did not ensure a person’s rights included the right to be treated with courtesy and respect.
Consistent information was provided that a staff person (S2) “yelled” at a client (C) or spoke with such a loud tone on the phone that the receiving end had to be hold the phone away from the ear to hear S2, and that S2 swore at the C about things s/he “needed to do.”
Corrective Action Ordered: Correct immediately and maintain compliance with this licensing requirement on a continuing basis throughout the program.
If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
