Dear Lensa Mohamed: On June 5, 2024, the Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration of citation 2 in the Correction Order (Attachment A) issued to you by the Department of Human Services on May 23, 2024. You did not request reconsideration of the remaining citation, and, as a result, that citation is final and not subject to review.
Citation 2: Violation: The license holder did not offer services as required. Specifically, the license holder failed to follow procedures for preparing, handling, and serving food that complied with chapter 4626, requirements for Food and Beverage Establishments, and with applicable local ordinances. At the time of the licensing review, DHS licensors observed staff preparing and serving coffee, beans, and bread to participants. However, the license holder failed to have a food license that would have allowed preparing and serving food. The license holder’s food license expired on April 1, 2020. Request for Reconsideration. You indicated that the facility did possess a valid food license at the time of the licensing review, and you provided documentation. You indicated the food license permits the warming of coffee, beans, and bread provided the items are served within one hour of preparation as confirmed by your city health inspector.
Reconsideration Determination. Pursuant to Minnesota Rules, part 9555.9710, subpart 1, procedures for preparing, handling, and serving food, and washing food, utensils, and equipment must comply with chapter 4626, Requirements for Food and Beverage Establishments, and with applicable ordinances. If the food is prepared off-site by another facility or if food service is provided according to a center’s contract with a food service provider, the facility or provider must comply with chapter 4626 and applicable local ordinances. Although you have now provided documentation of a food license and payment for the food license on February 29, 2024, the documentation does not include verification of the date the food license became effective. At the time of the licensing review on May 15, 2024, the license holder was unable to provide documentation of compliance and unable to provide a copy of an active food license when requested, and the facility did not dispute the violation during the exit interview. Also, the licensors contacted the city of Minneapolis by phone during the licensing review, and it was confirmed that the facility did not have a current food license. When licensors later contacted the city of Minneapolis on June 11, 2024, to confirm an effective date for the food license, the city was unable to verify the date the license became effective. There is therefore sufficient evidence to support the citation, and it is affirmed. Disposition: The Commissioner has reviewed the request for reconsideration and all the information submitted in response to the correction order. The Commissioner finds there is sufficient evidence to support citation 2, and it is affirmed. This is a final agency decision. Sincerely,
