CORRECTION ORDER
An investigation of Bar None Residential Services was completed regarding report number 202405159 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Rules, parts 2960.0010 to 2960.0120 (CRF). This maltreatment allegations concerned neglect. The disposition of the investigation report was maltreatment not determined and maltreatment determined. One violation was noted.
VIOLATION AND CORRECTION ORDER
The following violation of state and (or) federal laws and rules was observed. Corrective action for the violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violation within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.
Citation: Minnesota statutes section 260E.06, subdivision 1, paragraph (a).
Violation: A person who knows or has reason to believe that a child is being or has been maltreated failed to immediately report the information to the local welfare agency, agency responsible for investigating the report, police department, county sheriff, tribal social services agency, or tribal police department.
On January 11, 2024, a staff person (Person one) allegedly permitted a child to use a vaping device. Supervisory/administrative staff persons, including Persons two, three, and four, were each made aware of the alleged incident, but a report of alleged maltreatment was not made. Corrective Action Ordered: Immediately and on an ongoing basis, you must maintain compliance for reports of alleged maltreatment as required in this statute.
If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
