Terms of Settlement Agreement:
1. The License Holder’s family child care license will be placed on conditional status for a period of two years from the effective date of this Agreement. While under the conditional license, the License Holder must comply with the following terms:
a. License Holder must follow and comply with all applicable Minnesota Statutes and Rules, including Minnesota Rules, parts 9502.0300 through 9502.0445.
b. License Holder’s family child care license will be limited to a maximum capacity of twelve (12) children (class C2 license), and no variances to age distribution or capacity will be granted during the conditional period.
c. License Holder must ensure that Household Member identified in the Non-Public Provider Agreement does not have any unsupervised direct contact with, or access to, children served by the family child care program, except for their own children who are enrolled in the program.
d. License Holder must ensure that Household Member identified in the Non-Public Provider Agreement does not act as a caregiver or a substitute caregiver in the family child care program and that Household Member does not transport children served by the family child care program, except for his/her own children who are enrolled in the program.
e. License Holder must ensure that Household Member identified in the Non- Public Provider Agreement is not present in the licensed areas of the family child care program during the hours the program is in operation, except said Household Member may transition through a licensed area to or from an unlicensed area of the program so long as License Holder and Household Member comply with provisions 4.c. and 4.d. above.
f. The parties agree that Sherburne County Health and Human Services will monitor the family child care program’s compliance with the terms of this Agreement by conducting unannounced licensing review visits to the program’s residence and property according to the following schedule:
i. At least once a month for a duration of six (6) months from the effective date of this Agreement; and
ii. After the initial six-month period, if no additional licensing violations have been cited, Sherburne County may move to a visitation schedule of at least once every quarter until the end of the conditional period.
g. Once every quarter, License Holder must report Household Member’s progress in addressing his/her chemical dependency issues to Sherburne County Health and Human Services. If License Holder learns that Household Member is not in compliance with his/her chemical and mental health recommendations (not limited to his/her chemical dependency evaluation dated October 29, 2024), License Holder must immediately notify Sherburne County of the noncompliance.
h. License Holder must remove all firearms and/or ammunition from the residence and property of the family child care program. For the duration of License No. 1049319’s conditional status under this Agreement, License Holder must not allow any firearm and/or ammunition on the residence and property of the family child care program.
i. Pursuant to the specifications set forth in Minnesota Rules, part 9502.0335, subpart 2.D., Sherburne County Health and Human Services may require a physical, mental illness, or chemical dependency or abusive evaluation of License Holder or any caregiver or person living at the address of the family child care program or present during the hours children are in care.
2. License Holder must post this Agreement in her family child care program in a conspicuous place and provide a copy of this Agreement to parents or guardians of all children in care under License No. 1049319. License Holder must obtain signatures from parents or guardians of each child attending her family child care programs indicating they have received a copy of this Agreement. Documentation that the parents received a copy of this Agreement must be provided to Sherburne County Health and Human Services within thirty (30) calendar days of the effective date of this Agreement. For new families enrolling a child in the License Holder’s family child care program, License Holder must submit documentation signed by the parent or guardian to Sherburne County within five (5) days of the child beginning to receive family child care services from her family child care program that verifies that the parent received a copy of this Agreement.
