CORRECTION ORDER

Dear Ms. Murray:

On October 29 and 30, 2024, a Department of Human Services (DHS) licensor conducted a licensing review at your facility located at 505 Highway 169 North, Suite 505, Plymouth, MN 55441. As a result of this visit, DHS determined that Nexus is in violation of seven of the child placing agency rules and statutes. As a result, DHS is issuing this order which requires you to take the corrective action as described below. Details of our findings are provided below. Our next steps and your options are also detailed.

LICENSING VIOLATIONS

DHS determined that Nexus failed to follow licensing rules and statutes, as described below.

Notice of Reinspection

1. Violation: The agency’s grievance procedure does not permit clients to bring a grievance to the highest level of authority in the program, as required. The highest level of authority would be the Board of Directors.

Statute Violated: Minnesota Statutes, section 245A.04, subdivision 1, paragraph (d).

2. Violation: The agency’s bond must be made in favor of the agency which has agreed to receive the

records. The bond was in favor of the Minnesota Department of Human Services instead of Family Alternatives.

Statute Violated: Minnesota Statutes, section 245A.04, subdivision 10.

Repeat Violation: In a Correction Order that DHS issued on January 27, 2023, you were previously found in violation of this same statute.

3. Violations: The agency’s disclosure form did not contain the following items, as required:

· An estimated length of time for making an adoptive placement based on the preceding three to five years.

· A statement of services the agency will provide adoptive parents.

Statute Violated: Minnesota Statutes, section 245A.04, subdivision 10, item 2.

4. Violation: The Secretary of State’s website showed the agency had been involuntarily dissolved on February 22, 2024, and was reinstated on July 30, 2024, which violated the requirements of a legal organization.

Rule Violated: Minnesota Rules, part 9545.0785, subpart 3.

5. Violation: Your agency’s Description of Program and Services failed to include the statement that your agency complies with the Indian Child Welfare Act, Public Law 95-608; the Minnesota Indian Family Preservation Act, Minnesota Statutes, sections 260.751 to 260.835; the Heritage Act, Minnesota Statutes, sections 259.29, 260C.193, subdivision 3, and 260C.212, 260C.221, and 260C.215; and the Interstate Compact on the Placement of Children, Minnesota Statutes, section 260.851.

Rule Violated: Minnesota Rules, part 9545.0815, item G, subitems (1-4).

6. Violation: The agency’s plan for the transfer of records upon agency closure expired on July 3, 2023.

Rule Violated: Minnesota Rules, part 9545.0845.

Adoption File

7. Violation: Adoption file 1 did not have a complete disclosure form on file and was not signed and dated by each adoptive applicant.

Statute Violated: Minnesota Statutes, section 245A.04, subdivision 10.

Repeat Violation: In a Correction Order issued by DHS on January 27, 2023, you were previously found in violation of this same Rule.

Corrective action required for violations 1-7:

Submit documentation to your licensor within 30 days from when you received this order explaining how you plan to ensure ongoing compliance.

YOUR RIGHT TO REQUEST RECONSIDERATION

You have the right to request reconsideration of this order in writing. Your request must:

1. Specify the parts of the correction order that are alleged to be in error;

2. Explain why they are in error; and

3. Include documentation to support the allegation of error.

If you are mailing your request, it must be received by DHS within 20 calendar days from when you received this order. If you do not meet this deadline, you lose your right to request reconsideration. The timeline to appeal began when you received this order. Please send it to:

Legal authority for this licensing action

· This action is taken under Minnesota Statutes, section 245A.06, subdivision 1.

· This child placing agency must maintain compliance with the licensing statutes and rules, specifically Minnesota Rules, 9545.0755 through 9545.0845; Minnesota Statute, section 245A.04 subdivision 10: Minnesota Statutes, section 245.03; and Minnesota Statute, section 259.37, subdivision 2.

· The timeline to request reconsideration of the order is provided in Minnesota Statutes, section 245A.06, subdivision 2.
