Dear Donovan Chandler:
CORRECTION ORDER
An investigation of MSOCS Afton was completed regarding report number 202406062, which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned neglect. The disposition of the investigation report is inconclusive. Two violations were noted.
VIOLATIONS AND CORRECTION ORDERS
The following violations of state and (or) federal laws and rules were observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.
1. Citation: Minnesota Statutes section 245D.07, subdivision 1a, paragraph (a)
Violation: The license holder did not provide services in response to the person's identified needs, interests, preferences, and desired outcomes as specified in the coordinated service and support plan addendum.
A person served (P) Self-Management Assessment and Coordinated Service and Support Plan Addendum provided different information regarding how often staff persons were to check on the P. The Self-Management Assessment stated, “Staff will be aware of [the P’s] whereabouts by completing a personal check-in with [him/her] every 30-minutes,” and the P’s Coordinated Service and Support Plan Addendum stated, “All staff conduct 15-minute verbal check-ins with [the P].”
Consistent information was provided that on July 11, 2024, more than one staff person did not audibly or visually check on the P for 35 to 37 minutes while the P was in his/her bedroom.
Corrective Action Ordered: Correct immediately and maintain compliance with this licensing requirement on a continuing basis throughout the program.
2. Citation: Minnesota Statutes, Section 245D.09, subdivision 3, paragraph (a),
Violation: The license holder did not ensure that staff providing direct support were competent to meet the person’s needs and requirements as written in the support plan and support plan addendum.
The P’s plans outlined that 15- and 30-minute checks were required, and information showed that six staff persons (S1, S2, S3, S4, S5, and S6) were each trained on the P’s plans yet none were able to articulate what information the plans provided regarding the P’s checks. S1, S2, S3, S4, S5, and S6 each provided consistent information that there was no plan/protocol in place for checking on the P.
Corrective Action Ordered: Correct immediately and maintain compliance with this licensing requirement on a continuing basis throughout the program.
If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
